SENATE BILL

        INTRODUCED BY M. WHITE, FONTANA, PICCOLA, GORDNER, ROBBINS,
           REGOLA, RHOADES, MADIGAN, WAUGH, BAKER, ERICKSON, WONDERLING
           AND BROWNE, JUNE 1, 2007

        REFERRED TO ENVIRONMENTAL RESOURCES AND ENERGY, JUNE 1, 2007

                                     AN ACT

     1  Providing for environmental funds reporting and disclosure.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Short title.
     5     This act shall be known and may be cited as the Environmental
     6  Funds Reporting and Disclosure Act.
     7  Section 2.  Department responsibilities.
     8     The Department of Environmental Protection shall do all of
     9  the following:
    10         (1)  No later than July 30, 2007, and each year
    11     thereafter, compile and update a comprehensive report of all
    12     special funds and restricted revenue accounts administered by
    13     the Department of Environmental Protection, containing at a
    14     minimum:
    15             (i)  the total receipts and expenditures of each
    16         fund, including all fees, fines, penalties and natural
    17         resource damage awards or settlements;

     1             (ii)  an itemized list of each receipt and
     2         disbursement of the fund in excess of $10,000; and
     3             (iii)  the number and nature of violations of
     4         environmental statutes.
     5         (2)  A copy of the report required under paragraph (1)
     6     shall be submitted to the chairmen and minority chairmen of
     7     the Appropriations Committee and the Environmental Resources
     8     and Energy Committee of the Senate and the chairmen and
     9     minority chairmen of the Appropriations Committee and the
    10     Environmental Resources and Energy Committee of the House of
    11     Representatives.
    12         (3)  A copy of the report required under paragraph (1)
    13     shall be posted and maintained on the Department of
    14     Environmental Protection's publicly accessible Internet
    15     website.
    16  Section 3.  Transfers to General Fund.
    17     If the amount of all fines and penalties received by a
    18  special fund or restricted revenue account administered by the
    19  Department of Environmental Protection in a fiscal year
    20  increases more than 5% from the amount received in the previous
    21  fiscal year, the Secretary of the Budget shall transfer the
    22  amount of the increase in revenue which is in excess of 5% from
    23  the special fund or restricted revenue account to the Hazardous
    24  Sites Cleanup Fund established in section 602.3 of the act of
    25  March 4, 1971 (P.L.6, No.2), known as the Tax Reform Code of
    26  1971.
    27  Section 4.  Applicability.
    28     This act shall apply to any special fund or restricted
    29  revenue account administered by the Department of Environmental
    30  Protection, including, but not limited to, the Clean Air Fund,

     1  the Clean Water Fund, the Solid Waste Abatement Fund, the Safe
     2  Drinking Water Fund and the Waste Transportation Safety Account.
     3  Section 5.  Effective date.
     4     This act shall take effect immediately.
