AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, providing for telemedicine prohibited
for medication safety program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding a chapter to read:
CHAPTER 52C
TELEMEDICINE PROHIBITED FOR MEDICATION SAFETY PROGRAM

52C01. Definitions.

§ 52C01. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Health care professional." An individual licensed,
certified or otherwise authorized or permitted by the laws of

this Commonwealth to administer health care in the ordinary
course of business or in the practice of a profession and who
administers health care in this Commonwealth.
"Risk evaluation and mitigation strategy." The medication
safety program administered by the United States Food and Drug
Administration under section 505-1 of the Food and Drug
Administration Amendments Act of 2007 (121 Stat. 926, 21 U.S.C.
§ 355-1).
"Telemedicine." The use of telecommunication and information
technology by a health care professional to provide health care
to an individual in a different location from the health care
professional.
§ 52C02. Prohibition.
A health care professional may not use telemedicine to
administer or communicate with a patient located in this
Commonwealth regarding a medication for which the United States
Food and Drug Administration has issued a risk evaluation and
mitigation strategy.
Section 2. This act shall take effect in 60 days.
