SENATE BILL

        REFERRED TO APPROPRIATIONS, APRIL 21, 1997

                                     AN ACT

     1  Making an appropriation to the Lake Erie College of Osteopathic
     2     Medicine, Erie County.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The sum of $1,000,000 is hereby appropriated to
     6  the Lake Erie College of Osteopathic Medicine, Erie County, for
     7  the fiscal year July 1, 1997, to June 30, 1998, for instruction
     8  in the Doctor of Osteopathy program.
     9     Section 2.  Payments to the Lake Erie College of Osteopathic
    10  Medicine on account of the appropriation provided in section 1
    11  shall be made quarterly by the Secretary of Education on the
    12  basis of costs during the fiscal year. The secretary shall not
    13  release more than the first quarterly payment until such time as
    14  the Trustees of the Lake Erie College of Osteopathic Medicine
    15  agree in writing to include a minimum of five members appointed
    16  by the Governor and the General Assembly. The Governor, the
    17  President pro tempore of the Senate, the Minority Leader of the


     1  Senate, the Speaker of the House of Representatives and the
     2  Minority Leader of the House of Representatives may each, upon
     3  receipt of the written agreement from the trustees, appoint a
     4  nonelected official to serve as a member of the board and the
     5  terms of office shall be coterminous with that of their
     6  appointing authority.
     7     Section 3.  The Lake Erie College of Osteopathic Medicine
     8  shall provide full, complete and accurate information as may be
     9  required by the Department of Education or the chairman or the
    10  minority chairman of the Appropriations Committee of the Senate
    11  or the chairman or the minority chairman of the Appropriations
    12  Committee of the House of Representatives.
    13     Section 4.  The Lake Erie College of Osteopathic Medicine
    14  shall report its revenues and expenditures and present its
    15  financial statements in accordance with generally accepted
    16  accounting principles and procedures for educational
    17  institutions as set forth in the "Higher Education Finance
    18  Manual (1975)" and the "Commonwealth of Pennsylvania Budget
    19  Instructions for the State System of Higher Education, State-
    20  Related Universities and Non-State-Related Colleges and
    21  Universities."
    22     Section 5.  The Trustees of the Lake Erie College of
    23  Osteopathic Medicine shall report on forms provided by the
    24  Department of Education to both the chairman and minority
    25  chairman of the Appropriations Committee of the Senate and the
    26  chairman and minority chairman of the Appropriations Committee
    27  of the House of Representatives by September 30, 1998, on how
    28  State-appropriated funds were expended for fiscal year 1997-1998
    29  to reduce the costs to Pennsylvania resident students or to
    30  provide services to Pennsylvania residents.

     1     Section 6.  This act shall take effect July 1, 1997, or
     2  immediately, whichever is later.
