SENATE BILL

                                     AN ACT

     1  Amending the act of April 27, 1905 (P.L.312, No.218), entitled
     2     "An act creating a Department of Health, and defining its
     3     powers and duties," further providing for the Secretary of
     4     Health.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1 of the act of April 27, 1905 (P.L.312,
     8  No.218), entitled "An act creating a Department of Health, and
     9  defining its powers and duties," amended March 17, 1921 (P.L.37,
    10  No.18), is amended to read:
    11     Section 1.  Be it enacted, &c., That the Department of Health
    12  shall consist of a [Commissioner] Secretary of Health and an
    13  advisory board.
    14     The [Commissioner] Secretary of Health shall be the head of
    15  the department, and shall be appointed by the Governor, with the
    16  advice and consent of the Senate. [He shall be a physician of at
    17  least ten years professional experience and a graduate of a
    18  legally constituted medical college.


     1     The term of the Commissioner first appointed hereunder shall
     2  expire on the first day of March, one thousand nine hundred and
     3  seven, and the] The secretary must be an individual with
     4  experience and education deemed appropriate by the Governor. The
     5  term of office of [every Commissioner thereafter appointed] the
     6  secretary shall be four years, beginning on first day of March
     7  of the year in which he is appointed.
     8     [Upon the appointment and qualification of the Commissioner
     9  of Health, the terms of the members of the State Board of Health
    10  and the secretary of such board shall expire, and no
    11  appointments shall thereafter be made to those offices.]
    12     That the Department of Health shall have an official seal.
    13     Section 2.  This act shall take effect in 60 days.
