SENATE BILL

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for hindering identification
     3     of sexual offenders.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 5105.1.  Hindering identification of sexual offender.
     9     (a)  General rule.--A person who has reason to believe that a
    10  sexual offender has violated section 4915 (relating to failure
    11  to comply with registration of sexual offenders requirements)
    12  commits an offense if the person intentionally or knowingly does
    13  any of the following:
    14         (1)  Fails to notify law enforcement authorities of the
    15     violation.
    16         (2)  Withholds information from law enforcement
    17     authorities or provides false or misleading information to
    18     law enforcement authorities concerning the sexual offender or

     1     the violation.
     2         (3)  Harbors or conceals the sexual offender or assists
     3     another person in harboring or concealing the sexual
     4     offender.
     5     (b)  Penalty.--A violation of this section is an offense of
     6  the same grade and degree as the most serious offense committed
     7  by the sexual offender under section 4915.
     8     (c)  Definition.--As used in this section, the term "sexual
     9  offender" means a person who is required to register with the
    10  Pennsylvania State Police pursuant to the provisions of 42
    11  Pa.C.S. § 9795.1 (relating to registration).
    12     Section 2.  This act shall take effect in 60 days.
