                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for murder of the
     3     second degree.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definition of "perpetration of a felony" in
     7  section 2502(d) of Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended to read:
     9  § 2502.  Murder.

    11     (d)  Definitions.--As used in this section the following
    12  words and phrases shall have the meanings given to them in this
    13  subsection:
    14     "Perpetration of a felony."  The act of the defendant in
    15  engaging in or being an accomplice in the commission of, or an
    16  attempt to commit, or flight after committing, or attempting to
    17  commit robbery, rape, or deviate sexual intercourse by force or


     1  threat of force, arson, burglary [or], kidnapping or any felony
     2  under the act of April 14, 1972 (P.L.233, No.64), known as The
     3  Controlled Substance, Drug, Device and Cosmetic Act.

     5     Section 2.  This act shall take effect immediately.
