AN ACT 1 Authorizing and directing the Department of General Services, 2 with the approval of the Governor, to grant and convey to 3 Butler County, certain lands situate in the City of Butler, 4 Butler County, Pennsylvania. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Butler County. 8 (a) Authorization.--The Department of General Services, with 9 the approval of the Governor, is hereby authorized and directed 10 on behalf of the Commonwealth of Pennsylvania to grant and 11 convey to Butler County, 0.39-acres of land, more or less, and 12 building as described in subsection (b) for fair market value as 13 determined by an independent appraiser under terms and 14 conditions established in a lease and option to purchase 15 agreement with the department dated November 5, 2003. 16 (b) Property description.--The property to be conveyed 17 pursuant to subsection (a) consists of two parcels of land 18 totaling approximately 0.39-acres bounded and more particularly
1 described as follows: 2 PARCEL 1 3 ALL THAT CERTAIN lot or parcel of land situate in the Third 4 Ward of the City of Butler, Butler County, Commonwealth of 5 Pennsylvania, being located on the south side of West Cunningham 6 Street in the said City and having a frontage on said street of 7 forty five (45) feet, more or less, and extending south one 8 hundred eighty (180) feet to an alley, said lot being more fully 9 described as follows: 10 On the North by West Cunningham Street; on the East by lands 11 of now or formerly Casper Eith; on the South by an alley; and on 12 the West by lands of formerly William Graham, now Kradel. 13 PARCEL 2 14 ALL THAT CERTAIN lot or parcel of land, situate in the third 15 Ward of the City of Butler, Butler County, Pennsylvania, bounded 16 and described as follows: 17 On the North sixty seven (67) feet, more or less, by West 18 Cunningham Street; on the East one hundred eighty (180) feet, 19 more or less, by lot of Grantees; on the South fifty seven and 20 one-half (57.5) feet, more or less, by West Yogeley Street; on 21 the West one hundred eighty (180) feet, more or less, by lot of 22 Craftsman-Ziegler Company. 23 (c) Easements.--The conveyance shall be made under and 24 subject to all lawful and enforceable easements, servitudes and 25 rights of others, including, but not confined to streets, 26 roadways and rights of any telephone, telegraph, water, 27 electric, gas or pipeline companies, as well as under and 28 subject to any lawful and enforceable estates or tenancies 29 vested in third persons appearing of record, for any portion of 30 the land or improvements erected thereon. 20030S0975B1302 - 2 -
1 (d) Deed.--The deed of conveyance shall be by special 2 warranty deed and shall be executed by the Secretary of General 3 Services in the name of the Commonwealth of Pennsylvania. 4 (e) Costs.--Costs and fees incidental to this conveyance 5 shall be borne by the grantee. 6 (f) Alternative disposition.--In the event that this 7 conveyance is not executed within 180 days of the effective date 8 of this section, the property may be disposed of in accordance 9 with section 2406-A of the act of April 9, 1929 (P.L.177, 10 No.175), known as The Administrative Code of 1929. 11 Section 2.
