AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for purchase,
3 consumption, possession or transportation of liquor or malt
4 or brewed beverages.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 6308(a) of Title 18 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 6308. Purchase, consumption, possession or transportation of
10 liquor or malt or brewed beverages.
11 (a) Offense defined.--A person commits a summary offense if
12 he, being less than 21 years of age, attempts to purchase,
13 purchases, consumes, possesses, is under the influence of, or
14 knowingly and intentionally transports any liquor or malt or
15 brewed beverages, as defined in section 6310.6 (relating to
16 definitions). For the purposes of this section:
17 (1) A person shall be deemed to be under the influence
18 of liquor or malt or brewed beverages if there is any
1 evidence that the person has consumed any amount of liquor or
2 malt or brewed beverages.
3 (2) It shall not be a defense that the liquor or malt or
4 brewed beverages was consumed in a jurisdiction other than
5 the jurisdiction where the citation for underage drinking was
6 issued.
