SENATE BILL

           JUNE 11, 1990

                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     eligibility for medical assistance for inmates of public
     5     institutions.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 432(4) of the act of June 13, 1967
     9  (P.L.31, No.21), known as the Public Welfare Code, amended April
    10  1, 1976 (P.L.64, No.28), is amended to read:
    11     Section 432.  Eligibility.--Except as hereinafter otherwise
    12  provided, and subject to the rules, regulations, and standards
    13  established by the department, both as to eligibility for
    14  assistance and as to its nature and extent, needy persons of the
    15  classes defined in clauses (1), (2), and (3) shall be eligible
    16  for assistance:

    18     (4)  Assistance shall not be granted (i) to or in behalf of
    19  any person who disposed of his real or personal property, of the

     1  value of five hundred dollars ($500), or more, without fair
     2  consideration, within two years immediately preceding the date
     3  of application for assistance unless he is eligible for State
     4  supplemental assistance; or (ii) to an inmate of a public
     5  institution. Notwithstanding any provision of law to the
     6  contrary, the department shall provide medical assistance to any
     7  inmate of a county jail or prison, who would be eligible for
     8  medical assistance except for his or her status as an inmate,
     9  for all medical expenses OTHERWISE PAYABLE UNDER MEDICAL          <--
    10  ASSISTANCE which exceed thirty thousand dollars ($30,000) in any
    11  fiscal year.

    13     Section 2.  This act shall take effect in 60 days.
