AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, providing for product advertising requirements.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Part II heading of Title 3 of the Pennsylvania
6 Consolidated Statutes is amended and the part is amended by
7 adding a chapter to read:

16 § 1101. Definitions.
17 The following words and phrases when used in this chapter
1 shall have the meanings given to them in this section unless the
2 context clearly indicates otherwise:
3 "Substantially raised." Reared for more than 50% of life.
4 § 1102. Local products.
5 (a) Prohibition.--A person may not sell or offer for sale
6 any animal, animal product, plant or plant product with a
7 designation indicating that the item has been locally grown or
8 produced unless:
9 (1) In the case of an animal, the animal was born or
10 substantially raised in this Commonwealth.
11 (2) In the case of an animal product:
12 (i) the animal was born or substantially raised in
13 this Commonwealth; and
14 (ii) the product was processed entirely in this
15 Commonwealth.
16 (3) In the case of a plant, the plant was grown in this
17 Commonwealth.
18 (4) In the case of a plant product:
19 (i) the plant was grown in this Commonwealth; and
20 (ii) the product was processed entirely in this
21 Commonwealth.
22 (b) Grading.--A person that violates subsection (a) commits
23 a summary offense and shall, upon conviction, be sentenced to
24 pay a fine of $300.
25 Section 2. This act shall take effect in 60 days.
