SENATE BILL

           TOMLINSON, MELLOW, KITCHEN, SLOCUM, AFFLERBACH, FUMO,
           BRIGHTBILL AND PUNT, JUNE 20, 1997

                                     AN ACT

     1  Authorizing certified real estate appraisers to represent real
     2     property owners in certain real estate assessment appeals.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  County board appeal.
     6     A certified appraiser with a valid authorization from a
     7  property owner may represent that property owner in the real
     8  estate assessment appeal process at the county board of
     9  assessment appeal level. This includes any or all appearances
    10  before assessment officials, a revaluation company and/or a
    11  county board of assessment appeals or similarly empowered body.
    12  Section 2.  Allowable activities.
    13     Since the real estate assessment appeal process at the county
    14  board of assessment appeal level, including appearances before
    15  assessment officials, revaluation company and/or county board of
    16  assessment appeals or similarly empowered body is an
    17  administrative matter related solely to the determination of the


     1  market value of a property for real estate assessment purposes,
     2  the activities of the certified appraiser shall not be construed
     3  as the unauthorized practice of law.
     4  Section 3.  Court appeals.
     5     The further appeal of a property assessment decision beyond
     6  the county board of assessment level to common pleas court shall
     7  be a "de novo" proceeding.
     8  Section 4.  Effective date.
     9     This act shall take effect immediately.
