SENATE BILL

        REFERRED TO GAME AND FISHERIES, AUGUST 6, 1999

                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, restricting the use of certain revenues; and
     3     establishing a restricted account within the Game Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 521(b) of Title 34 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 521.  Establishment and use of Game Fund.
    10     * * *
    11     (b)  Specific allocation of certain revenues.--
    12         (1)  A minimum of $1.25 from each resident license for
    13     which the full fee has been paid and a minimum of $2 from
    14     each antlerless deer license issued for which the full fee
    15     has been paid shall be used solely for habitat improvement
    16     and restoration conducive to increasing natural propagation
    17     of game or wildlife on all lands under the control or
    18     operation of the commission, including lands enrolled in the

     1     commission's public access programs and other public lands
     2     open to hunting under agreement with the commission. The
     3     moneys collected under this paragraph shall be deposited into
     4     two separate accounts and shall be used exclusively for the
     5     natural propagation of game and wildlife by:
     6             (i)  Improving and maintaining any natural wildlife
     7         habitat by the production, distribution and planting of
     8         trees, shrubs, vines and forage crops.
     9             (ii)  Forest management practices related to the
    10         creation and development of food and cover.
    11             (iii)  Development and management of food and cover
    12         openings.
    13             (iv)  Purchase, construction and enhancement of
    14         wetlands and riparian areas.
    15             (v)  Construction and maintenance of nesting
    16         structures.
    17             (vi)  The prorated cost for the purchase, maintenance
    18         and operation of equipment, tools and materials necessary
    19         to meet the habitat improvement objectives of this
    20         section. No moneys in these accounts shall be used for
    21         capital purchases under this subparagraph.
    22     The commission shall submit an annual report on all
    23     expenditures from this account in the manner prescribed under
    24     section 522 (relating to appropriation and audit of moneys).
    25         (2)  Any moneys collected by or for the commission from
    26     the sale of the migratory bird hunting license shall be used
    27     solely for the purpose of migratory game bird management,
    28     habitat acquisition and improvement and related program
    29     administrative costs.
    30         (3)  A minimum of $3 from each resident and nonresident

     1     license for which the full fee has been paid shall be used
     2     solely for habitat improvement and restoration conducive to
     3     increasing natural propagation of game on all lands under the
     4     control or operation of the commission, including lands
     5     enrolled in the commission's public access programs and other
     6     public lands open to hunting under agreement with the
     7     commission. The moneys collected under this paragraph shall
     8     be used exclusively for the natural propagation of game by:
     9             (i)  Improving and maintaining any natural wildlife
    10         habitat by the production, distribution and planting of
    11         trees, shrubs, vines and forage crops.
    12             (ii)  Forest management practices related to the
    13         creation and development of food and cover.
    14             (iii)  Development and management of food and cover
    15         openings.
    16             (iv)  Construction and enhancement of wetlands and
    17         riparian areas.
    18             (v)  Construction and maintenance of nesting
    19         structures.
    20             (vi)  The prorated cost for the maintenance and
    21         operation of equipment, tools and materials necessary to
    22         meet the habitat improvement objectives of this section.
    23         No moneys in these accounts shall be used for capital
    24         purchases under this subparagraph.
    25     The commission shall submit an annual report on all
    26     expenditures from this account in the manner prescribed under
    27     section 522.
    28         (4)  All moneys from the sale of oil, gas, minerals or
    29     right-of-way easements on any lands under the control or
    30     operation of the commission shall be used solely for game and

     1     wildlife propagation and habitat improvement.
     2     (c)  Restricted account.--All moneys specifically allocated
     3  under subsection (b) shall be deposited into a separate account
     4  within the Game Fund which shall be known as the Propagation and
     5  Habitat Improvement Account. The moneys in this account shall be
     6  used exclusively for the purposes of game and wildlife
     7  propagation and habitat improvement and as more specifically set
     8  forth in subsection (b). No portion of the moneys in this
     9  account may be used to pay or reimburse any costs associated
    10  directly or indirectly with the commercial sale of timber or
    11  wood used for fuel.
    12     Section 2.  This act shall take effect January 1, 2000.
