SENATE BILL

                                     AN ACT

     1  Authorizing cities of the second class to impose property
     2     maintenance ordinances.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Property maintenance ordinance.
     6     A city of the second class may impose property maintenance
     7  ordinances and any standard or nationally recognized property
     8  maintenance code. The property maintenance ordinance may provide
     9  penalties of fines not exceeding one per month on a property and
    10  limited to no more than $1,000 for the first two continual and
    11  uncorrected violations of the same subsection of such ordinance
    12  on the same property and not exceeding $5,000 for the third and
    13  any subsequent continual and uncorrected violation of the same
    14  subsection of such ordinance on the same property.
    15  Section 2.  Graded penalties.
    16     If a violation of the property maintenance ordinance is found
    17  to pose a threat to the public's health, safety or property,
    18  then penalties of fine may be provided for as follows:

     1         (1)  Not exceeding one citation per five calendar days
     2     for a continual and uncorrected violation of the same
     3     subsection of such ordinance on the same property.
     4         (2)  Limited to no less than $500 and no more than $1,000
     5     for the first two continual and uncorrected violations of the
     6     same subsection of such ordinance on the same property and no
     7     less than $1,000 and not exceeding $10,000 for the third and
     8     any subsequent continual and uncorrected violation of the
     9     same subsection of such ordinance on the same property or to
    10     imprisonment for any term not exceeding 90 days, or both.
    11  Section 3.  Effective date.
    12     This act shall take effect in 60 days.
