        INTRODUCED BY BRIGHTBILL, JUBELIRER, CONTI, COSTA, SALVATORE,
           TOMLINSON, O'PAKE, CORMAN, WENGER, LEMMOND, MUSTO, WOZNIAK,
           HART, GERLACH, ROBBINS, WAUGH, STOUT, BOSCOLA, MELLOW AND
           THOMPSON, DECEMBER 8, 1999

        AS AMENDED ON SECOND CONSIDERATION, FEBRUARY 7, 2000

                                     AN ACT

     1  Amending the act of July 6, 1989 (P.L.169, No.32), entitled, as
     2     amended, "An act providing for the regulation of storage
     3     tanks and tank facilities; imposing additional powers and
     4     duties on the Department of Environmental Protection and the
     5     Environmental Quality Board; and making an appropriation,"
     6     reenacting authority for a certain allocation under the
     7     Underground Storage Tank Environmental Cleanup Program; AND    <--
     8     FURTHER PROVIDING FOR THE UPGRADE LOAN PROGRAM.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 710(b.2) SECTIONS 710(B.2) AND 712(B) of   <--
    12  the act of July 6, 1989 (P.L.169, No.32), known as the Storage
    13  Tank and Spill Prevention Act, added January 30, 1998 (P.L.46,
    14  No.13), is ARE reenacted and amended to read:                     <--
    15  Section 710.  Underground Storage Tank Environmental Cleanup
    16                 Program.

    18     (b.2)  Additional allocation.--No more than $500,000 of the
    19  annual allocation for the Underground Storage Tank Environmental
    20  Cleanup Program may be used for costs of corrective action to

     1  assist owners of underground storage tanks with a capacity of
     2  3,000 gallons or less used for storing heating oil for
     3  consumption on the premises where stored. Payments authorized
     4  under this subsection may be made only for releases occurring on
     5  or after the effective date of this subsection. Payments made
     6  for eligible releases shall be limited in amount to the actual
     7  costs of corrective action or to $5,000, whichever is less. The
     8  amount allowed shall be subject to a $1,000 deductible which
     9  shall be paid first by the claimant. This subsection shall
    10  expire [two years from the effective date of this subsection]
    11  June 30, 2005. On or before that date, the board shall make a
    12  report to the General Assembly with recommendations. The board
    13  may promulgate regulations to carry out the provisions of this
    14  subsection.

    16  SECTION 712.  UPGRADE LOAN PROGRAM.                               <--

    18     (B)  ELIGIBILITY.--SUCH LOANS SHALL BE MADE AVAILABLE TO
    19  OWNERS OF SIX OR FEWER REGULATED UNDERGROUND STORAGE TANKS FOR
    20  THE PURPOSE OF UPGRADING OR REMOVING THEIR STORAGE TANKS. ANY
    21  PORTION OF THE ANNUAL AVAILABILITY OF FUNDS NOT COMMITTED TO
    22  SUCH OWNERS WITHIN 90 DAYS OF THE EFFECTIVE DATE OF THIS SECTION
    23  AND THEREAFTER WITHIN 90 DAYS OF JULY 1 IN ANY FISCAL YEAR MAY
    24  BE AWARDED TO ANY OWNER OF ANY NUMBER OF REGULATED UNDERGROUND
    25  STORAGE TANKS THAT MEET THE REMAINING REQUIREMENTS OF THIS
    26  SECTION.

    28     Section 2.  This act shall take effect immediately.
