        INTRODUCED BY BRIGHTBILL, JUBELIRER, CONTI, COSTA, SALVATORE,
           TOMLINSON, O'PAKE, CORMAN, WENGER, LEMMOND, MUSTO, WOZNIAK,
           HART, GERLACH, ROBBINS, WAUGH, STOUT, BOSCOLA, MELLOW AND
           THOMPSON, DECEMBER 8, 1999

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           NOVEMBER 21, 2000

                                     AN ACT

     1  Amending the act of July 6, 1989 (P.L.169, No.32), entitled, as
     2     amended, "An act providing for the regulation of storage
     3     tanks and tank facilities; imposing additional powers and
     4     duties on the Department of Environmental Protection and the
     5     Environmental Quality Board; and making an appropriation,"
     6     reenacting authority for a certain allocation under the
     7     Underground Storage Tank Environmental Cleanup Program; and
     8     further providing for the upgrade loan program.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Sections 710(b.2) and 712(b) of the act of July
    12  6, 1989 (P.L.169, No.32), known as the Storage Tank and Spill
    13  Prevention Act, added January 30, 1998 (P.L.46, No.13), are
    14  reenacted and amended to read:
    15  Section 710.  Underground Storage Tank Environmental Cleanup
    16                 Program.

    18     (b.2)  Additional allocation.--No more than $500,000 of the


     1  annual allocation for the Underground Storage Tank Environmental
     2  Cleanup Program may be used for costs of corrective action to
     3  assist owners of underground storage tanks with a capacity of
     4  3,000 gallons or less used for storing heating oil for
     5  consumption on the premises where stored. [Payments authorized    <--
     6  under this subsection may be made only for releases occurring on
     7  or after the effective date of this subsection.] Payments made    <--
     8  for eligible releases shall be limited in amount to the actual
     9  costs of corrective action or to $5,000, whichever is less. The
    10  amount allowed shall be subject to a $1,000 deductible which
    11  shall be paid first by the claimant. This subsection shall
    12  expire [two years from the effective date of this subsection]
    13  June 30, 2005. On or before that date, the board shall make a
    14  report to the General Assembly with recommendations. The board
    15  may promulgate regulations to carry out the provisions of this
    16  subsection.

    18  Section 712.  Upgrade Loan Program.

    20     (b)  Eligibility.--Such loans shall be made available to
    21  owners of six or fewer regulated underground storage tanks for
    22  the purpose of upgrading or removing their storage tanks. Any
    23  portion of the annual availability of funds not committed to
    24  such owners within 90 days of the effective date of this section
    25  and thereafter within [90] 120 days of July 1 in any fiscal year
    26  may be awarded to any owner of any number of regulated
    27  underground storage tanks that meet the remaining requirements
    28  of this section.

    30     SECTION 2.  THE REENACTMENT AND AMENDMENT OF SECTION 710(B.2)  <--

     1  OF THE ACT SHALL APPLY RETROACTIVELY TO FEBRUARY 1, 2000.
