        AS AMENDED ON THIRD CONSIDERATION, NOVEMBER 16, 1999

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to sell and convey to Transitional
     3     Housing and Care Center of Columbia and Montour Counties
     4     certain land and a building, referred to as the Gatehouse,
     5     situate on Danville State Hospital, Montour County; AND        <--
     6     AUTHORIZING THE DEPARTMENT OF TRANSPORTATION, WITH THE
     7     APPROVAL OF THE GOVERNOR, TO SELL AND CONVEY TO THE PUBLIC
     8     AUDITORIUM AUTHORITY OF ALLEGHENY COUNTY CERTAIN LAND SITUATE
     9     IN THE CITY OF PITTSBURGH, COUNTY OF ALLEGHENY, COMMONWEALTH
    10     OF PENNSYLVANIA.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13  Section 1.  Conveyance at Danville State Hospital, Montour
    14                 County.
    15     (a)  Authorization.--The Department of General Services, with
    16  the approval of the Governor, is hereby authorized on behalf of
    17  the Commonwealth of Pennsylvania to grant and convey to
    18  Transitional Housing and Care Center of Columbia and Montour
    19  Counties the tract of land and building, referred to as the
    20  Gatehouse, described in subsection (b), for fair consideration
    21  based on a fair market value as determined by an independent


     1  appraisal.
     2     (b)  Description.--The property to be conveyed pursuant to
     3  subsection (a) is the following tract of land and building
     4  situate on Danville State Hospital, Montour County bounded and
     5  described as follows:
     6     BEGINNING at a point on the northerly edge of the macadam on
     7  an access road, said point being North 18 degrees 19 minutes 56
     8  seconds West 122.66 feet from a point in the centerline
     9  intersection of another macadam access road and existing
    10  railroad tracks; thence along the northerly edge of the macadam
    11  on the first mentioned access road, North 42 degrees 42 minutes
    12  48 seconds West, a distance of 650.73 feet to a point; thence
    13  passing through a rebar set on line 5.00 feet from the last
    14  mentioned corner, North 46 degrees 38 minutes 57 seconds East, a
    15  distance of 195.62 feet to a rebar set; thence passing through a
    16  rebar set on line 5.00 feet from the next mentioned corner,
    17  South 43 degrees 18 minutes 25 seconds East, a distance of
    18  332.45 feet to a point on a curve on the westerly edge of the
    19  macadam on another access road; thence along the westerly edge
    20  of the macadam on said access road and along a curve to the left
    21  having a radius of 182.19 feet, arc length of 113.80 feet, delta
    22  angle of 35 degrees 47 minutes 20 seconds, a chord bearing of
    23  South 14 degrees 24 minutes 38 seconds West, and a chord length
    24  of 111.96 feet to a point; thence along the same and along a
    25  curve to the left having a radius of 100.32 feet, arc length of
    26  57.92 feet, delta angle of 33 degrees 04 minutes 44 seconds, a
    27  chord bearing of South 15 degrees 35 minutes 36 seconds East,
    28  and a chord length of 57.12 feet to a point; thence along the
    29  same, South 23 degrees 46 minutes 43 seconds East, a distance of
    30  120.26 feet to a point; thence along the same, South 24 degrees

     1  20 minutes 09 seconds East, a distance of 100.60 feet to a point
     2  of curve; thence the same and along a curve to the right having
     3  a radius of 4.87 feet, arc length of 9.84 feet, delta angle of
     4  115 degrees 51 minutes 53 seconds, a chord bearing of South 49
     5  degrees 47 minutes 15 seconds West, a chord length of 8.25 feet
     6  to the place of BEGINNING.
     7     CONTAINING 2.000 acres of land in all.
     8     (c)  Easements.--The conveyance shall be made under and
     9  subject to any and all easements for utilities which cross said
    10  property, including, but not limited to, streets, roadways and
    11  rights of any storm sewer, electric service, potable water
    12  service and a sanitary sewer lateral, as well as under and
    13  subject to any interest, estates or tenancies vested in third
    14  persons appearing of record, for any portion of the land or
    15  improvements erected thereon.
    16     (d)  Execution.--The deed of conveyance shall be approved as
    17  provided by law and shall be executed by the Secretary of
    18  General Services in the name of the Commonwealth of
    19  Pennsylvania. In the event this property is not conveyed to
    20  Transitional Housing and Care Center of Columbia and Montour
    21  Counties within 12 months of the effective date of this act, at
    22  the discretion of the Secretary of General Services, the
    23  property shall be offered for sale through auction, sealed bid
    24  or request for proposal, under the terms of the act of April 9,
    25  1929 (P.L.177, No.175), known as The Administrative Code of
    26  1929. and conditions in section 2405-A of The Administrative      <--
    27  Code of 1929 authorizing the sale of the herein noted property
    28  to Transitional Housing and Care Center of Columbia and Montour
    29  Counties shall automatically cease and become null and void.
    30     (e)  Costs.--All other costs and fees, including, but not

     1  limited to, appraisal fees, title insurance and surveys,
     2  incidental to this conveyance shall be borne by the Grantee.
     3  SECTION 2.  CONVEYANCE TO PUBLIC AUDITORIUM AUTHORITY,            <--
     4                 ALLEGHENY COUNTY.
     5     (A)  AUTHORIZATION.--THE DEPARTMENT OF TRANSPORTATION, WITH
     6  THE APPROVAL OF THE GOVERNOR AND THE FEDERAL HIGHWAY
     7  ADMINISTRATION, IS HEREBY AUTHORIZED ON BEHALF OF THE
     8  COMMONWEALTH OF PENNSYLVANIA TO GRANT AND CONVEY TO THE PUBLIC
     9  AUDITORIUM AUTHORITY OF ALLEGHENY COUNTY FOR FAIR CONSIDERATION
    10  AS DETERMINED BY THE DEPARTMENT OF TRANSPORTATION THE TRACT OF
    11  LAND DESCRIBED IN SUBSECTION (B).
    12     (B)  DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO
    13  SUBSECTION (A) IS THE FOLLOWING TRACT OF LAND SITUATE IN THE
    14  21ST WARD, CITY OF PITTSBURGH, ALLEGHENY COUNTY, BOUNDED AND
    15  DESCRIBED AS FOLLOWS:
    16     BEGINNING AT A POINT AT THE WESTERN RIGHT OF WAY LINE OF
    17  ALLEGHENY AVENUE, SAID POINT BEING LOCATED SOUTH 2 DEGREES 31
    18  MINUTES 51 SECONDS WEST 49.98 FEET FROM STATION 1039+56.99 FEET
    19  AT THE CENTERLINE OF THE SOUTHBOUND LANE OF LEGISLATIVE ROUTE
    20  1039. THENCE SOUTH 14 DEGREES 02 MINUTES 43 SECONDS EAST 17.26
    21  FEET TO A POINT OF CURVATURE OF THE WESTERN RIGHT OF WAY LINE OF
    22  ALLEGHENY AVENUE, SAID LINE BEING 32.00 FEET FROM CENTERLINE OF
    23  ALLEGHENY AVENUE, THE TRUE POINT OF BEGINNING. THENCE BY A CURVE
    24  BEARING TO THE RIGHT WITH A RADIUS OF 1064.60 FEET FOR AN ARC
    25  DISTANCE OF 156.35 FEET TO A POINT OF TANGENCY ON THE WESTERN
    26  RIGHT OF WAY LINE OF ALLEGHENY AVENUE. THENCE ALONG THE WESTERN
    27  RIGHT OF WAY LINE OF ALLEGHENY AVENUE, SOUTH 05 DEGREES 37
    28  MINUTES 50 SECONDS EAST A DISTANCE OF 20.57 FEET, TO A POINT ON
    29  THE NORTHERN RIGHT OF WAY LINE OF RELOCATED REEDSDALE STREET.
    30  THENCE ALONG THE NORTHERN RIGHT OF WAY LINE OF REEDSDALE STREET

    17     CONTAINING AN AREA OF 1.30 ACRES ACCORDING TO A SURVEY BY L.
    18  ROBERT KIMBALL AND ASSOCIATES DATED APRIL 29, 1999.
    19     THIS CONVEYANCE IS COMPRISED OF A PORTION OF THE PROPERTY AS
    20  CONVEYED TO THE COMMONWEALTH OF PENNSYLVANIA BY THE URBAN
    21  REDEVELOPMENT AUTHORITY OF THE CITY OF PITTSBURGH BY DEED DATED
    22  AUGUST 24, 1994, AND RECORDED IN DEED BOOK VOLUME 9930, PAGE 151
    23  IN THE RECORDERS OFFICE OF ALLEGHENY COUNTY.
    24     (C)  CONDITION.--PRIOR TO EXECUTION OF A DEED OF CONVEYANCE,
    25  THE SLOPE OF STATE ROUTE 65 ADJACENT TO THE TRACT OF LAND
    26  DESCRIBED IN SUBSECTION (B) SHALL BE STABILIZED AND RETURNED TO
    27  ITS ORIGINAL CONDITION IN A MANNER ACCEPTABLE TO THE DEPARTMENT
    28  OF TRANSPORTATION.
    29     (D)  EASEMENTS.--THE CONVEYANCE SHALL BE MADE UNDER AND
    30  SUBJECT TO ALL EASEMENTS, AND RIGHTS OF OTHERS, INCLUDING, BUT

     1  NOT CONFINED TO, STREETS, ROADWAYS AND RIGHTS OF ANY TELEPHONE,
     2  TELEGRAPH, CABLE, WATER, ELECTRIC, SEWER, GAS OR PIPELINE
     3  COMPANIES, AS WELL AS UNDER AND SUBJECT TO ANY INTEREST, ESTATES
     4  OR TENANCIES VESTED IN THIRD PERSONS, WHETHER OR NOT APPEARING
     5  OF RECORD, FOR ANY PORTION OF THE LAND OR IMPROVEMENTS ERECTED
     6  THEREON.
     7     (E)  EXECUTION.--THE DEED OF CONVEYANCE SHALL BE APPROVED AS
     8  PROVIDED BY LAW AND SHALL BE EXECUTED BY THE SECRETARY OF
     9  GENERAL SERVICES IN THE NAME OF THE COMMONWEALTH OF
    10  PENNSYLVANIA.
    11     (F)  COSTS.--ALL OTHER COSTS AND FEES, INCLUDING, BUT NOT
    12  LIMITED TO, APPRAISAL FEES, TITLE INSURANCE AND SURVEYS
    13  INCIDENTAL TO THIS CONVEYANCE, SHALL BE BORNE BY THE GRANTEE.
    14     (G)  DISPOSITION OF PROCEEDS.--REVENUE FROM THE SALE
    15  AUTHORIZED BY THIS ACT SHALL BE DEPOSITED IN THE MOTOR LICENSE
    16  FUND.
    17  Section 2 3.  Effective date.                                     <--
    18     This act shall take effect immediately.
