AN ACT
1 Providing for a monument in honor of United Airlines Flight 93
2 victims; conferring powers and imposing duties on the
3 Department of General Services; and establishing the Flight <--
4 93 Victims Memorial Fund; AND PROVIDING FOR SOLICITATION OF <--
5 CONTRIBUTIONS.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Short title.
9 This act shall be known and may be cited as the Flight 93
10 Victims Memorial Act.
11 Section 2. Declaration of policy.
12 The General Assembly finds and declares as follows:
13 (1) The magnitude and severity of the brutal terrorist
14 attack on the United States that occurred the morning of
15 September 11, 2001, is unprecedented.
16 (2) One of four civilian aircraft hijacked in the
17 terrorist attack crashed in Somerset County, Pennsylvania,
1 and all 45 passengers and crew members aboard that aircraft, 2 United Airlines Flight 93, lost their lives. 3 (3) The aircraft crashed when passengers attempted to 4 overcome the hijackers and prevent an act of terrorism 5 similar to that which was inflicted upon the World Trade 6 Center and the Pentagon. 7 (4) A monument commemorating the lives of the innocent 8 passengers and crew of Flight 93 is only appropriate to 9 express this Commonwealth's heartfelt sympathy to the 10 families of the victims of Flight 93 and deepest appreciation 11 to the victims themselves. 12 Section 3. Definitions. 13 The following words and phrases when used in this act shall 14 have the meanings given to them in this section unless the 15 context clearly indicates otherwise: 16 "Department." The Department of General Services of the 17 Commonwealth. 18 "Fund." The Flight 93 Victims Memorial Fund established in 19 section 5. 20 Section 4. Duties of department. 21 The department shall have the duty to: 22 (1) Erect a physical monument to memorialize and honor 23 the innocent victims who lost their lives when United 24 Airlines Flight 93 crashed on September 11, 2001. The 25 monument shall be located in Somerset County, on or near the 26 site where the crash occurred. 27 (2) Receive for and on behalf of the Commonwealth 28 monetary gifts or bequests which shall be deposited in the 29 fund. 30 (3) Receive for and on behalf of the Commonwealth real 20010S1106B1568 - 2 -
1 property upon which the monument shall be erected. 2 (4) Do all other things necessary or convenient to carry 3 out the powers granted to it by this act. 4 Section 5. Flight 93 Victims Memorial Fund. 5 (a) Establishment and administration.--There is hereby 6 established a separate fund in the State Treasury to be known as 7 the Flight 93 Victims Memorial Fund. Money received by the 8 department for purposes of this act shall be paid into the State 9 Treasury and credited to the fund. The fund shall be 10 administered by the department, and all moneys in the fund are 11 appropriated to the department on a continuing basis. 12 (b) Purpose.--The moneys in the fund shall be used for the 13 selection, design and construction of an appropriate physical 14 monument as described under section 4 and other costs incidental 15 thereto. 16 SECTION 6. SOLICITATION OF CONTRIBUTIONS. <-- 17 (A) PUBLIC SERVICE ANNOUNCEMENTS.-- 18 (1) THE DEPARTMENT, IN CONJUNCTION WITH THE TREASURY 19 DEPARTMENT, SHALL DEVELOP A PROGRAM OF PUBLIC SERVICE 20 ANNOUNCEMENTS TO BE BROADCAST ON THE VARIOUS RADIO AND 21 TELEVISION STATIONS OF THIS COMMONWEALTH, AS MAY BE DEEMED 22 APPROPRIATE, FOR THE PURPOSE OF SOLICITING PUBLIC, PRIVATE 23 AND CORPORATE CONTRIBUTIONS FOR THE MONUMENT. ALL SUCH 24 CONTRIBUTIONS SHALL BE DEPOSITED IN THE FUND. 25 (2) THE DEPARTMENT, IN ITS DISCRETION, MAY DEVELOP THE 26 PUBLIC SERVICE ANNOUNCEMENTS THROUGH THE BUREAU OF 27 COMMONWEALTH MEDIA SERVICES OR THROUGH THE USE OF MEDIA OR 28 MARKETING CONSULTANTS. THE DEPARTMENT MAY ALSO DEVELOP 29 PRINTED SOLICITATION MATERIALS FOR PUBLIC DISPLAY AND FOR 30 INCLUSION IN APPROPRIATE COMMONWEALTH MAILINGS TO THE PUBLIC. 20010S1106B1568 - 3 -
1 SUCH MAILINGS MAY INCLUDE, BUT ARE NOT LIMITED TO, DEPARTMENT 2 OF TRANSPORTATION VEHICLE REGISTRATION RENEWAL AND DRIVER'S 3 LICENSE RENEWAL FORMS, DEPARTMENT OF REVENUE TAX FORMS AND 4 TAX REFUND CHECKS, AND PAYROLL AND BENEFIT CHECKS PROCESSED 5 BY THE TREASURY DEPARTMENT. 6 (B) REIMBURSEMENT FOR COSTS.--COSTS INCURRED BY THE 7 DEPARTMENT PURSUANT TO THIS SECTION SHALL BE REIMBURSED FROM THE 8 FUND. 9 Section 6 7. Completion date. <-- 10 The monument shall be completed no later than two years 11 following the effective date of this act. 12 Section 7 8.
