AN ACT 1 Providing for tuition assistance to certain employees who were 2 laid off or terminated. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Tuition and 7 Fees Assistance Act. 8 Section 2. Definitions. 9 The following words and phrases when used in this act shall 10 have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Agency." The Pennsylvania Higher Education Assistance 13 Agency created by the act of August 7, 1963 (P.L.549, No.290), 14 referred to as the Pennsylvania Higher Education Assistance 15 Agency Act. 16 "Community college." A public college or technical institute 17 which is established and operated under Article XIX-A of the act
1 of March 10, 1949 (P.L.30, No.14), known as the Public School 2 Code of 1949, and all branches or campuses of a community 3 college. 4 "Employee." A resident of this Commonwealth who is or was an 5 employee of US Airways, was employed at a US Airways facility 6 located in this Commonwealth or whose employment was principally 7 localized in this Commonwealth and who was laid off or 8 terminated for reasons other than just cause on or after 9 September 11, 2001. 10 "State-owned institution." An institution which is part of 11 the State System of Higher Education under Article XX-A of the 12 act of March 10, 1949 (P.L.30, No.14), known as the Public 13 School Code of 1949, and all branches and campuses of a State- 14 owned institution. 15 "State-related institution." The Pennsylvania State 16 University, the University of Pittsburgh, Temple University, the 17 Pennsylvania College of Technology and Lincoln University. 18 "Tuition and fees." The instructional charge and any other 19 fee established by the governing board of a community college 20 for Commonwealth residents attending the community college or 21 the instructional fee established by the Board of Governors of 22 the State System of Higher Education for Commonwealth residents 23 attending State-owned institutions. The term includes tuition 24 and fees set by the respective governing bodies of the State- 25 related institutions. 26 Section 3. Assistance for tuition and fees. 27 (a) Assistance.--The agency shall provide assistance for 28 tuition and fees for any employee who was enrolled in a 29 community college, State-owned institution or State-related 30 institution or who enrolls in a community college, State-owned 20010S1107B1388 - 2 -
1 institution or State-related institution before January 1, 2003. 2 (b) Other grants.--The agency shall not reduce the amount of 3 other agency grants or aid for which the employee qualifies on 4 account of the employee's eligibility for or receipt of grants 5 under this act. 6 Section 4. Severability. 7 The provisions of this act are severable. If any provision of 8 this act or its application to any person or circumstance is 9 held invalid, the invalidity shall not affect other provisions 10 or applications of this act which can be given effect without 11 the invalid provision or application. 12 Section 10.
