THE GENERAL ASSEMBLY OF PENNSYLVANIA


SENATE BILL

No. 1112 Session of 1997


        INTRODUCED BY WOZNIAK, COSTA, LAVALLE, TARTAGLIONE, BODACK,
           WAGNER, AFFLERBACH, STOUT, O'PAKE, MUSTO, HART AND KASUNIC,
           SEPTEMBER 23, 1997

                                     AN ACT

     1  Providing for the compensation of election officers; and making
     2     repeals.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the District
     7  Election Officers Compensation Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "District Election Board."  The election officers required
    13  for the conduct of elections in any election district in
    14  accordance with the act of June 3, 1937 (P.L.1333, No.320),
    15  known as the Pennsylvania Election Code.
    16     "Election."  Any general, municipal, special or primary
    17  election.


     1     "Election district."  A district, division or precinct
     2  established in accordance with the act of June 3, 1937
     3  (P.L.1333, No.320), known as the Pennsylvania Election Code, in
     4  which all qualified electors vote in one polling place.
     5  Section 3.  Compensation.
     6     (a)  Schedule.--Compensation of judges of election,
     7  inspectors of election, clerks and machine operators as provided
     8  in Article IV of the act of June 3, 1937 (P.L.1333, No.320),
     9  known as the Pennsylvania Election Code, shall be fixed by the
    10  county board of elections for each election in accordance with
    11  the following:

    15      Inspectors of Election,
    16      clerks and machine operators       $40.00          $95.00
    17     (b)  Per diem by category.--The county board of elections
    18  may, in its discretion, establish different per diem rates
    19  within the above-mentioned minima and maxima based on the number
    20  of votes cast for the following groups:
    21         (1)  150 votes or less.
    22         (2)  151 to 300 votes.
    23         (3)  301 to 500 votes.
    24         (4)  501 to 750 votes.
    25         (5)  751 votes and over.
    26  Section 4.  Additional compensation.
    27     (a)  Transmitting returns and ballot boxes.--For transmitting
    28  returns of elections and the ballot box or boxes, all judges of
    29  elections shall be entitled to receive the additional sum of
    30  $10.

     1     (b)  Minority inspector.--The county board of elections may,
     2  in its discretion, require the minority inspector of elections
     3  to accompany the judge of elections in transmitting the returns
     4  of elections in which case the minority inspector of elections
     5  shall be entitled to receive the additional sum of $10.
     6     (c)  Mileage.--The person furnishing transportation to the
     7  judge of elections and the minority inspector in transmitting
     8  returns and ballot boxes shall be entitled to a minimum of 30¢
     9  per circular mile from the polling place to the county court
    10  house. The name of such person shall appear on the voucher of
    11  the judge of elections and only one person shall receive mileage
    12  compensation.
    13     (d)  Constable or deputy constable.--A constable or deputy
    14  constable performing duties under section 1207 of the act of
    15  June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
    16  Election Code, shall receive compensation at the same rate
    17  payable to an inspector or a clerk under section 3.
    18  Section 5.  Multiple elections.
    19     When a primary and special election or a special election and
    20  a general or municipal election take place on the same date,
    21  they shall be construed as one election for the purpose of
    22  receiving compensation.
    23  Section 6.  Repeals.
    24     (a)  Specific.--Section 412.1 of the act of June 3, 1937
    25  (P.L.1333, No.320), known as the Pennsylvania Election Code, is
    26  repealed.
    27     (b)  Inconsistent.--All acts and parts of acts are repealed
    28  insofar as they are inconsistent with this act.
    29  Section 7.  Application of act.
    30     This act shall be applicable as constitutionally permissible.

     1  Section 8.  Effective date.
     2     This act shall take effect January 1, 1998.
