AS AMENDED ON THIRD CONSIDERATION, NOVEMBER 14, 1989
AN ACT 1 Providing for the recording and reporting of certain laboratory 2 tests; and imposing additional powers and duties on the 3 Secretary of Health. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Human 8 Immunodeficiency Virus Reporting Act. 9 Section 2. Laboratory recording. 10 All laboratories in this Commonwealth performing serologic 11 testing for human immunodeficiency virus (HIV) shall routinely 12 record the number of preliminary HIV tests performed, the number 13 of confirmatory HIV tests performed, and the number of 14 confirmatory HIV tests showing positive results. These records 15 shall not contain information identifying the person whose blood 16 has been tested. 17 Section 3. Laboratory reporting.
1 All records required by section 2 shall be reported to the
2 Department of Health periodically as determined by the Secretary
3 of Health, but no less than once a year.
4 Section 4. Rules and regulations.
5 The Department of Health shall promulgate rules and
6 regulations to carry out the provisions of this act.
7 Section 5. Powers and duties.
8 The Secretary of Health shall correlate COLLATE the <--

10 and report to the General Assembly annually.
11 Section 6. Effective date.
12 This act shall take effect in 60 days.
