                                     AN ACT

     1  Amending Title 24 (Education) of the Pennsylvania Consolidated
     2     Statutes, providing for return to school service in an
     3     extracurricular position.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8346 of Title 24 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 8346.  Termination of annuities.
     9     * * *
    10     (b.1)  Return to school service in an extracurricular
    11  position.--An annuitant may be employed by a school entity or
    12  charter school in an extracurricular position outside regular
    13  instructional hours and not part of mandated curriculum under
    14  separate contract, without loss of annuity, provided such
    15  employer annually certifies to the board that:
    16         (1)  The annuitant has not retired under an early
    17     retirement provision provided under this act within two years
    18     from the beginning of the contract.

     1         (2)  Neither the annuitant nor the employer shall make
     2     contributions to the member's savings account or State
     3     accumulation account respectively for such service.
     4  Further, such contract shall contain a waiver whereby the
     5  annuitant waives any potential retirement benefits that could
     6  arise from the contract and to release the employer and the
     7  board from any obligations.

     9     Section 2.  The addition of 24 Pa.C.S. § 8346(b.1) shall be
    10  retroactive to July 1, 1999.
    11     Section 3.  This act shall take effect immediately.
