           DECEMBER 8, 1997

                                     AN ACT

     1  Transferring the authority for the regulation of bottled water
     2     to the Department of Agriculture.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Transfer of authority for bottled water.
     6     The functions, powers and duties of the Department of
     7  Environmental Protection and the Environmental Quality Board
     8  concerning a PUBLIC WATER system which provides water for         <--
     9  bottling in sealed bottles or other sealed containers OR BULK     <--
    10  HAULING FOR HUMAN CONSUMPTION, including, but not limited to,
    11  sources of water and collection, treatment, storage, bottling,
    12  manufacturing and distribution facilities, contained in the
    13  relevant provisions of the act of May 1, 1984 (P.L.206, No.43),
    14  known as the Pennsylvania Safe Drinking Water Act, and any other
    15  relevant statutes and the regulations promulgated thereunder,
    16  INCLUDING REGULATIONS FOR VENDED WATER, RETAIL WATER SYSTEMS AND  <--
    17  HAULERS, are hereby transferred to the Department of


     1  Agriculture. ALL EQUIPMENT, FILES, RECORDS, AGREEMENTS AND ALL    <--
     2  OTHER MATERIALS AND SUPPLIES WHICH ARE USED, EMPLOYED OR
     3  EXPENDED BY THE DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR THE
     4  PURPOSES OF IMPLEMENTING THE RELEVANT PROVISIONS OF THE
     5  PENNSYLVANIA SAFE DRINKING WATER ACT ARE HEREBY TRANSFERRED TO
     6  THE DEPARTMENT OF AGRICULTURE. For ascertaining compliance with
     7  the act, the Department of Agriculture may accept the results of
     8  inspections by an independent third party and monitoring or
     9  testing of the water by an independent laboratory certified for
    10  that purpose and approved by the Department of Environmental
    11  Protection.
    12  Section 2.  Effective date.
    13     This act shall take effect in 60 days JULY 1, 1998.            <--
