                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor and the Department of Public
     3     Welfare, to grant and convey to Frenchcreek Township, Venango
     4     County, approximately 65.36 acres which includes the sewage
     5     treatment facilities, conveyance system, all improvements
     6     thereon and easements, at Polk Center in Polk Borough,
     7     Venango County.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10  Section 1.  Polk Borough, Venango County.
    11     (a)  Authorization.--The Department of General Services, with
    12  the approval of the Governor and the Department of Public
    13  Welfare, is hereby authorized on behalf of the Commonwealth of
    14  Pennsylvania to grant and convey to Frenchcreek Township,
    15  Venango County, approximately 65.36 acres consisting of the Polk
    16  Center sewage treatment facilities, conveyance system and
    17  easements, as described in subsection (b), for fair
    18  consideration equal to the fair market value as determined by an
    19  independent appraisal, in accordance to the Lease with Option to
    20  Purchase Agreement dated June 28, 2002, with the Department of

     1  General Services.
     2     (b)  Property description.--The property to be conveyed,
     3  pursuant to subsection (a) consists of approximately 65.36 acres
     4  and improvements, known as the Polk Center sewage treatment
     5  facilities, conveyance system and right-of-way more particularly
     6  described as follows:
     7     ALL THAT CERTAIN piece or parcel of land, situate in Polk
     8  Borough, Venango County, Pennsylvania, bounded and described as
     9  follows:
    10     BEGINNING at a point in the Centerline of S.R. 62 and the
    11  Centerline of S.R. 3024, said point being the southwest corner
    12  of the parcel herein described,
    13     Thence North 30 degrees 22 minutes 02 seconds West a distance
    14  of 183.88 feet along the Centerline of S.R. 3024 to a point,
    15     Thence North 16 degrees 33 minutes 26 seconds West a distance
    16  of 623.49 feet still along the Centerline of S.R. 3024 to a
    17  point,
    18     Thence North 16 degrees 56 minutes 12 seconds West a distance
    19  of 562.62 feet still along the Centerline of S.R. 3024 to a
    20  point,
    21     Thence North 31 degrees 41 minutes 21 seconds East a distance
    22  of 1361.69 feet to a Rebar and Cap, said line passing through a
    23  Rebar and Cap at a distance of 33.31 feet,
    24     Thence South 88 degrees 35 minutes 40 seconds East a distance
    25  of 1,200.47 feet along the Borough of Polk and the French Creek
    26  Township Line to a Rebar and Cap,
    27     Thence South 05 degrees 29 minutes 17 seconds West a distance
    28  of 1,234.24 feet to the center line of S.R. 62, said line
    29  passing through a Rebar and Cap at a distance of 1,204.24 feet,
    30     Thence South 52 degrees 25 minutes 29 seconds West a distance

     1  of 1,304.00 Feet along the Centerline of S.R. 62 to a point,
     2     Thence along the Centerline of S.R. 62 on a curve to the left
     3  having a Radius of 1103.02 feet, an Arc distance of 447.56 feet,
     4  a Chord Bearing of South 40 degrees 48 minutes 02 seconds West
     5  and a Chord distance of 444.49 feet to a point,
     6     Thence South 31 degrees 29 minutes 48 seconds West a distance
     7  of 74.48 feet along the Centerline of S.R. 62 to a point, said
     8  point being the Place of Beginning.
     9     The above-described parcel contains or is said to contain
    10  2,846,962 square feet or 65.36 acres of land more or less.
    11     The above described parcel is subject to a 50 foot Right-of-
    12  Way along Pines School Road as shown on a Plan titled Minor
    13  Subdivision for Commonwealth of Pennsylvania, Department of
    14  General Services, prepared by Land and Mapping Services, dated
    15  December 5, 2002.
    16     LESS AND EXCEPTING, ALL THAT CERTAIN piece or parcel of land,
    17  situate in Polk Borough, Venango County, Pennsylvania, bounded
    18  and described as follows:
    19     Commencing at a Rebar and Cap on the East Right-of-Way Line
    20  of S.R. 3024 and the South Right-of-Way Line of Pines School
    21  Road,
    22     Thence North 52 degrees 02 minutes 31 seconds East a distance
    23  of 743.13 feet along the South Right-of-Way Line of Pines School
    24  Road to a Rebar and Cap, said Point being the Place of
    25  Beginning,
    26     Thence North 52 degrees 02 minutes 31 seconds East a distance
    27  of 250.00 feet still along the South Right-of-Way Line of Pines
    28  School Road to a Rebar and Cap,
    29     Thence South 37 degrees 57 minutes 29 seconds East a distance
    30  of 200.00 feet to a Rebar and Cap,

     1     Thence South 52 degrees 02 minutes 31 seconds West a distance
     2  of 250.00 feet to a Rebar and Cap,
     3     Thence North 37 degrees 57 minutes 29 seconds West a distance
     4  of 200.00 feet to a Rebar and Cap, said point being the Place of
     5  Beginning.
     6     The above-described parcel contains or is said to contain
     7  50000 square feet or 1.15 Acres of land more or less.
     8     The above described parcel is subject to a 50 foot Right-of-
     9  Way along Pines School Road as shown on a Plan titled Minor
    10  Subdivision for Commonwealth of Pennsylvania, Department of
    11  General Services, prepared by Land and Mapping Services, dated
    12  December 5, 2002.
    13  All those certain Easements described as follows:
    14  Easement No. 1 - Polk Center
    15  Easement 20 feet in width with centerline beginning at a point S
    16  6 degrees 37 minutes 50 seconds E 123.70 feet from the
    17  intersection of the centerline of S.R.0062 and the property line
    18  that separates the property of Donald J. and Doris M. Yount and
    19  Polk Center, thence N 34 degrees 43 minutes 31 seconds W 109.09
    20  feet to a point, thence S 89 degrees 53 minutes 45 seconds W
    21  344.78 feet to a point, thence N 85 degrees 37 minutes 39
    22  seconds W 352.91 feet to a point, thence S 73 degrees 40 minutes
    23  44 seconds W 126.48 feet to a point being the approximate center
    24  of Pumping Station No. 1, thence S 72 degrees 5 minutes 48
    25  seconds W 123.40 feet to a point, thence N 70 degrees 49 minutes
    26  55 seconds W 7.64 feet to a point, thence N 91 degrees 45
    27  minutes 18 seconds W 29.96 feet to a point on the edge of the
    28  right-of-way of S.R.0062 approximately 25 feet from the
    29  centerline of S.R.0062.
    30  Easement No. 2 - Polk Center

     1  Easement 20 feet in width with centerline beginning at a point
     2  which lies in Little Sandy Creek, N 10 degrees 19 minutes 50
     3  seconds E 97.30 feet from the intersection of S.R.0062 and the
     4  property line that separates the property of John R. and
     5  Katherine Frederick and Polk Center, thence S 70 degrees 28
     6  minutes 57 seconds W 89.64 feet to the point of beginning,
     7  thence N 65 degrees 2 minutes 18 seconds W 12.01 feet to a
     8  point, thence N 23 degrees 23 minutes 40 seconds W 224.54 feet
     9  to a point, thence N 19 degrees 29 minutes 45 seconds E 7.46
    10  feet to a point, thence S 79 degrees 35 minutes 55 seconds W
    11  69.71 feet onto lands leased to Frenchcreek Township by document
    12  dated June 28, 2002.
    13  LESS AND EXCEPTING the portion of the easement on lands under
    14  the jurisdiction of the Fish and Boat Commission and identified
    15  in a License Agreement between the Fish and Boat Commission and
    16  Frenchcreek Township.
    17  Also the distribution system easement being 10 feet on either
    18  side of the existing sanitary sewer lines throughout Polk Center
    19  as indicated on the plan "GSA 84B, Water Main and Sanitary
    20  Sewer, Polk State Hospital by Robert Hall Craig, Consulting
    21  Engineer, Dated March 1942, as revised.
    22     (c)  Easements.--The conveyance shall be made under and
    23  subject to all lawful and enforceable easements, servitudes and
    24  rights of others, including but not confined to streets,
    25  roadways and rights of any telephone, telegraph, water,
    26  electric, gas or pipeline companies, as well as under and
    27  subject to any lawful and enforceable estates or tenancies
    28  vested in third persons appearing of record, for any portion of
    29  the land or improvements erected thereon.
    30     (d)  Execution.--The deed of conveyance shall be executed by

     1  the Secretary of General Services in the name of the
     2  Commonwealth of Pennsylvania.
     3     (e)  Costs and fees.--Costs and fees incidental to this
     4  conveyance shall be borne by the lessee.
     5     Section 2.  This act shall take effect immediately.
