AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for "special mobile equipment."
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. The definition of "special mobile equipment" in
6 section 102 of Title 75 of the Pennsylvania Consolidated
7 Statutes is amended to read:
8 § 102. Definitions.
9 Subject to additional definitions contained in subsequent
10 provisions of this title which are applicable to specific
11 provisions of this title, the following words and phrases when
12 used in this title shall have, unless the context clearly
13 indicates otherwise, the meanings given to them in this section:

15 "Special mobile equipment."
16 (1) Vehicles not designed or used primarily for the
17 transportation of persons or property, except for tools and
1 parts necessary for the use and maintenance of the vehicle,
2 and only incidentally operated or moved over a highway.
3 (2) Vehicles which have machinery permanently attached
4 shall not carry a load, except for tools and parts necessary
5 for the use and maintenance of the permanently attached
6 machinery and are only incidentally operated or moved over a
7 highway.
8 (3) Motor vehicles used primarily for road and bridge
9 maintenance or repair which carry a load of asphalt emulsion
10 or epoxy and aggregate material, that is applied as a
11 finished product by the vehicle's equipment directly to a
12 highway or trafficway for maintenance or repair of the road
13 or bridge surface.
14 The term includes, but is not limited to, ditch digging
15 apparatus, well boring apparatus; earth moving and road
16 construction and maintenance machinery, such as asphalt
17 spreaders, bituminous mixers, bucket loaders, snowplows,
18 ditchers, graders, patchers, finishing machines, road rollers,
19 scarifiers, earth moving carryalls, scrapers, power shovels and
20 drag lines; and self-propelled cranes and tractors, other than
21 truck tractors. The term does not include house trailers; dump
22 trucks; or truck-mounted transit mixers, cranes or shovels.

24 Section 2. Section 4524 of Title 75 is amended by adding a
25 subsection to read:
26 § 4524. Windshield obstructions and wipers.

28 (f) Exemptions.--Subsections (a), (b), (c) and (e) do not
29 apply to motor vehicles used in construction or maintenance of
30 highways, trafficways and bridges.

1 Section 3. Any act, statute, rule or regulation which
2 conflicts with any provision of this act is repealed insofar as
3 it is inconsistent with this act.
4 Section 4. This act shall take effect in 60 days.
