SENATE BILL

           MOWERY AND LEMMOND, DECEMBER 21, 2001

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," further providing for
     5     duties of supervisors.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 607 of the act of May 1, 1933 (P.L.103,
     9  No.69), known as The Second Class Township Code, reenacted and
    10  amended November 9, 1995 (P.L.350, No.60), is amended to read:
    11     Section 607.  Duties of Supervisors.--The board of
    12  supervisors shall:
    13     (1)  Be charged with the general governance of the township
    14  and the execution of legislative, executive and administrative
    15  powers in order to ensure sound fiscal management and to secure
    16  the health, safety and welfare of the citizens of the township.
    17     (2)  Have the responsibility for maintenance of township-
    18  owned equipment and facilities.
    19     (3)  Employ persons as may be necessary for the general

     1  conduct of the business of the township and provide for the
     2  compensation, organization and supervision of the persons so
     3  employed. Records shall be kept and reports made and filed
     4  giving the names of all persons employed, dates on which work
     5  was done and the number of hours worked with compensation paid
     6  to each person and the capacity in which employed.
     7     (4)  Authorize attendance at conferences, institutes,
     8  schools, court hearings, training and educational seminars and
     9  conventions. Any working or nonworking supervisor, elected or
    10  appointed officer or township employe may if directed by the
    11  board of supervisors attend any conference, institute, school,
    12  court hearings, training and educational seminars or convention
    13  dealing with the duties and functions of elected or appointed
    14  officers or employes. The expenses for attending the meetings
    15  may be paid by the township and are limited to the registration
    16  fee, mileage for the use of a personal vehicle or reimbursement
    17  of actual transportation expense going to and returning from the
    18  meeting plus all other actual expenses that the board of
    19  supervisors agrees to pay. Every attendee shall submit to the
    20  board of supervisors an itemized account of expenses incurred at
    21  the meeting. The board of supervisors may authorize employes to
    22  be compensated at their regular employe rate during their
    23  attendance at the meeting. The board of supervisors may
    24  determine the compensation for nonworking supervisors.
    25     (5)  Annually, on or before the first day of February,
    26  furnish to the board of auditors information on the construction
    27  or maintenance of roads or other matters that may be required by
    28  any department of the Commonwealth to be included in the annual
    29  township report.
    30     (6)  Provide for the annual tax duplicate to be prepared and

     1  presented to the tax collector.
     2     (7)  Perform duties and exercise powers as may be imposed or
     3  conferred by law or the rules and regulations of any agency of
     4  the Commonwealth.
     5     Section 2.  This act shall take effect in 60 days.
