SENATE BILL

No. 1279 Session of 1989


        INTRODUCED BY SCANLON, REGOLI AND BELAN, OCTOBER 10, 1989

                                     AN ACT

     1  Amending the act of August 10, 1951 (P.L.1189, No.265),
     2     entitled, as amended, "An act regulating the appointment,
     3     promotion, suspension, reduction, removal and reinstatement
     4     of employes (except superintendents, assistant
     5     superintendents, inspectors, chief clerks and school guards)
     6     in bureaus of police in cities of the second class; and
     7     defining the powers and duties of civil service commissions
     8     in such cities for such purposes," providing for
     9     authorization for second class cities that are home rule
    10     municipalities to enact, by referendum, alternate means of
    11     police discipline and regulation.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  The act of August 10, 1951 (P.L.1189, No.265),
    15  entitled, as amended, "An act regulating the appointment,
    16  promotion, suspension, reduction, removal and reinstatement of
    17  employes (except superintendents, assistant superintendents,
    18  inspectors, chief clerks and school guards) in bureaus of police
    19  in cities of the second class; and defining the powers and
    20  duties of civil service commissions in such cities for such
    21  purposes," is amended by adding a section to read:
    22     Section 9.1.  Any city of the second class which is a home

     1  rule municipality may, in lieu of the procedures set forth
     2  elsewhere in this act, determine its method of police
     3  discipline, removal and general regulation of police officers
     4  through a home rule charter amendment. Council, by ordinance,
     5  may propose, in any election, only one question to be presented
     6  to the voters. If more than one question is placed before the
     7  voters, the question with the highest number of votes will
     8  prevail.
     9     Section 2.  This act shall take effect immediately.
