AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, providing for the 3 definition of "dangerous juvenile offender." 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6302 of Title 42 of the Pennsylvania 7 Consolidated Statutes is amended by adding a definition to read: 8 § 6302. Definitions. 9 The following words and phrases when used in this chapter 10 shall have, unless the context clearly indicates otherwise, the 11 meanings given to them in this section: 12 * * * 13 "Dangerous juvenile offender." A child who has been 14 determined by the court to meet all of the following 15 requirements: 16 (1) Is 15 years of age or older. 17 (2) Has been adjudicated delinquent for one or more of 18 the following offenses:
1 (i) Attempted murder. 2 (ii) Voluntary manslaughter. 3 (iii) Rape. 4 (iv) Involuntary deviate sexual intercourse. 5 (v) Kidnapping. 6 (vi) Robbery as defined in 18 Pa.C.S. § 7 3701(a)(1)(i), (ii) or (iii) (relating to robbery). 8 (vii) Felonious aggravated assault as defined in 18 9 Pa.C.S. § 2702 (relating to aggravated assault). 10 (viii) Aggravated assault with a deadly weapon. 11 (ix) Arson as defined in 18 Pa.C.S. § 3301(a) 12 (relating to arson and related offenses). 13 (3) Has been previously adjudicated delinquent 14 subsequent to the child's 12th birthday for one or more of 15 the following offenses: 16 (i) Attempted murder. 17 (ii) Voluntary manslaughter. 18 (iii) Rape. 19 (iv) Involuntary deviate sexual intercourse. 20 (v) Kidnapping. 21 (vi) Robbery as defined in 18 Pa.C.S. § 22 3701(a)(1)(i), (ii) or (iii) (relating to robbery). 23 (vii) Felonious aggravated assault as defined in 18 24 Pa.C.S. § 2702 (relating to aggravated assault). 25 (viii) Aggravated assault with a deadly weapon. 26 (ix) Arson as defined in 18 Pa.C.S. § 3301(a) 27 (relating to arson and related offenses). 28 An adjudication for an offense arising from the same criminal 29 episode as the offense considered under paragraph (2) shall not 30 be considered an adjudication for the purpose of this paragraph. 20020S1279B1686 - 2 -
