AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in preliminary provisions, providing
for interscholastic athletics during disaster emergency.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 129. Interscholastic Athletics During Disaster
Emergency.--(a) Notwithstanding 35 Pa.C.S. § 7301 (relating to
general authority of Governor) or any other provision of law, an
executive order may not prohibit a parent or guardian from
monitoring, in person, the safety of their children at an
interscholastic sporting event during a disaster emergency. If
admission is charged for admittance into an interscholastic
sporting event, a parent or guardian under this subsection shall
be responsible for paying the admission.

(b) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Disaster emergency." A declaration of disaster emergency
made in accordance with 35 Pa.C.S. § 7301.
"Interscholastic athletics." All athletic contests or
competitions conducted between or among school entities.
"Interscholastic sporting event." Any of the following
conducted for grades kindergarten through twelve:
(1) Interscholastic athletics.
(2) An athletic contest or competition, other than
interscholastic athletics, that is sponsored by or associated
with a school entity, including cheerleading, club-sponsored
sports activities and sports activities sponsored by school-
affiliated organizations.
(3) Noncompetitive cheerleading that is sponsored by or
associated with a school entity.
(4) Practices, interschool practices and scrimmages for all
of the activities listed under clauses (1), (2) and (3).
"Nonpublic school." A nonprofit school, other than a school
entity, wherein a resident of this Commonwealth may legally
fulfill the compulsory school attendance requirements of this
act and which meets the requirements of Title VI of the Civil
Rights Act of 1964 (Public Law 88-352, 78 Stat. 241).
"School entity." A school district, joint school district,
charter school, regional charter school, public school,
nonpublic school, private school, intermediate unit or area
career and technical school.
Section 2. This act shall take effect immediately.
