AN ACT 1 Establishing the Community and Economic Development Advisory 2 Committee. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Community and 7 Economic Development Advisory Committee Act. 8 Section 2. Legislative intent. 9 It is the intent of this act to keep the Governor and the 10 General Assembly informed as to needs and priorities of 11 community and economic development services within this 12 Commonwealth. This will be achieved through the creation of a 13 State Community and Economic Development Advisory Committee 14 which shall review existing statutes, programs, funding and 15 activities by State and local agencies which affect economic 16 development within this Commonwealth. 17 Section 3. Definitions.
1 The following words and phrases when used in this act shall 2 have the meanings given to them in this section unless the 3 context clearly indicates otherwise: 4 "Department." The Department of Community and Economic 5 Development of the Commonwealth. 6 "Secretary." The Secretary of Community and Economic 7 Development of the Commonwealth. 8 "State agency." The Governor, departments, boards, 9 commissions, authorities and other agencies and officers of the 10 Commonwealth government, including those subject to the policy 11 supervision and control of the Governor. The term does not 12 include any court or other officer or agency of the unified 13 judicial system or the General Assembly and its officers and 14 agencies. 15 Section 4. Community and Economic Development Advisory 16 Committee. 17 (a) Establishment.--The department shall establish the 18 Community and Economic Development Advisory Committee 19 hereinafter referred to as CEDAC. 20 (b) Purpose and responsibilities.-- 21 (1) The Community and Economic Development Advisory 22 Committee shall review Statewide community and economic 23 development service needs and priorities and shall advise the 24 department on coordination of Federal, State and local 25 resources and how Statewide needs and priorities should be 26 addressed by the department's annual financing strategy. 27 (2) The membership shall be geographically dispersed in 28 order to include urban, suburban and rural areas. Every 29 effort shall also be made to ensure a diversity of race, 30 ethnic origin, household composition, age, religion, sex and 20000S1292B1669 - 2 -
1 disability status. 2 (3) Meetings shall be advertised and conducted pursuant 3 to the act of July 3, 1986 (P.L.388, No.84), known as the 4 Sunshine Act. 5 (4) The department shall present a report annually to 6 the legislature which will detail the findings and decisions 7 of the CEDAC for the previous year. 8 (c) Composition.-- 9 (1) The CEDAC will be chaired by the secretary and will 10 meet at least semiannually. The Governor will appoint CEDAC 11 members to serve two-year terms, except members of the 12 General Assembly and the representatives elected by each 13 regional community and economic development advisory 14 committee. Support staff for the CEDAC will be provided by 15 the department. 16 (2) No member will receive compensation or remuneration 17 for participation on the CEDAC. 18 (3) The CEDAC shall consist of at least 25 but no more 19 than 35 residents of this Commonwealth and shall include, at 20 a minimum, the following: 21 (i) The secretary or a designee thereof. 22 (ii) The Secretary of Labor and Industry or a 23 designee thereof. 24 (iii) The Secretary of Public Welfare or a designee 25 thereof. 26 (iv) Two members of the Senate, one appointed by the 27 President pro tempore and the other by the Minority 28 Leader. 29 (v) Two members of the House of Representatives, one 30 appointed by the Speaker of the House of Representatives 20000S1292B1669 - 3 -
1 and the other by the Minority Leader. 2 (vi) The Executive Director of the Pennsylvania 3 Chamber of Business and Industry or a designee thereof. 4 (vii) The Executive Director of the Pennsylvania 5 Economic Development Agency (PEDA) or a designee thereof. 6 (viii) The Executive Director of the Urban 7 Redevelopment Authority of Philadelphia or a designee 8 thereof. 9 (ix) The Executive Director of the Urban 10 Redevelopment Authority of Pittsburgh or a designee 11 thereof. 12 (x) A representative from the Ben Franklin 13 Technology Centers. 14 (xi) The Executive Director of the Pennsylvania 15 Small Business Development Center or a designee thereof. 16 (xii) A representative from The Pennsylvania 17 Industrial Development Authority (PIDA) or a designee 18 thereof. 19 (xiii) A representative from The Pennsylvania 20 Housing and Redevelopment Authority or a designee 21 thereof. 22 (xiv) The Executive Director of the African-American 23 Chamber of Commerce or a designee thereof. 24 (xv) A representative of the Industrial Development 25 Authorities and Corporations within this Commonwealth. 26 (xvi) A representative of the Industrial Resource 27 Centers within this Commonwealth. 28 (xvii) A representative of the banking industry. 29 (xviii) A representative of the county tourism 30 promotion agencies. 20000S1292B1669 - 4 -
1 (xix) The Executive Director of the Pennsylvania 2 Economic Development Financing Authority or a designee 3 thereof. 4 (d) Subcommittees and ad hoc committees.--The CEDAC may, as 5 it deems necessary, establish subcommittees and ad hoc 6 committees, comprised of non-CEDAC members, to assess special 7 needs and obtain public input. These subcommittees and ad hoc 8 committees will report to CEDAC. 9 Section 5. Powers and duties. 10 The CEDAC shall have the responsibility and authority: 11 (1) To advise the Governor and the General Assembly in 12 regards to community and economic development policies 13 Statewide. 14 (2) To review existing economic development statutes and 15 recommend changes. 16 (3) To review existing economic development programs and 17 recommend changes. 18 (4) To review any activities of other State agencies 19 that affect economic development within this Commonwealth. 20 (5) To review any educational and job training funding 21 that supports industrial growth. 22 Section 6. Severability. 23 The provisions of this act are severable. If any provision of 24 this act or its application to any person or circumstance is 25 held invalid, the invalidity shall not affect other provisions 26 or applications of this act which can be given effect without 27 the invalid provision or application. 28 Section 7.
