| AN ACT |
| |
1 | Amending the act of June 22, 1937 (P.L.1987, No.394), entitled, |
2 | as amended, "An act to preserve and improve the purity of the |
3 | waters of the Commonwealth for the protection of public |
4 | health, animal and aquatic life, and for industrial |
5 | consumption, and recreation; empowering and directing the |
6 | creation of indebtedness or the issuing of non-debt revenue |
7 | bonds by political subdivisions to provide works to abate |
8 | pollution; providing protection of water supply and water |
9 | quality; providing for the jurisdiction of courts in the |
10 | enforcement thereof; providing additional remedies for |
11 | abating pollution of waters; imposing certain penalties; |
12 | repealing certain acts; regulating discharges of sewage and |
13 | industrial wastes; regulating the operation of mines and |
14 | regulating the impact of mining upon water quality, supply |
15 | and quantity; placing responsibilities upon landowners and |
16 | land occupiers and to maintain primary jurisdiction over |
17 | surface coal mining in Pennsylvania," further providing for |
18 | the Clean Water Fund and for industrial waste discharges. | <-- |
19 | The General Assembly of the Commonwealth of Pennsylvania |
20 | hereby enacts as follows: |
21 | Section 1. Section 8(a) of the act of June 22, 1937 |
22 | (P.L.1987, No.394), known as The Clean Streams Law, amended |
23 | October 10, 1980 (P.L.894, No.157), is amended and the section |
24 | is amended by adding a subsection to read: |

1 | Section 8. Clean Water Fund.--(a) All fines collected under |
2 | the penal provisions of this act, all civil penalties collected |
3 | under section 605 of this act, all permit fees except those |
4 | imposed pursuant to sections 202, 203 and 207 and all bond |
5 | forfeitures and costs recovered under section 315 shall be paid |
6 | into the Treasury of the Commonwealth in a special fund known as |
7 | "The Clean Water [Fund," which shall be administered by the |
8 | department for use in the elimination of pollution.] Fund." The |
9 | department may use money in the fund for any of the following |
10 | purposes: |
11 | (1) The elimination or reduction of pollution. |
12 | (2) The prevention or mitigation of risks posed by the West |
13 | Nile Virus. |
14 | (3) For black fly suppression. |
15 | (4) For planning, enforcement and other grants authorized |
16 | under section 6 of the act of January 24, 1966 (1965 P.L.1535, |
17 | No.537), known as the "Pennsylvania Sewage Facilities Act." |

19 | (c) No later than March 31 of each year, the department |
20 | shall submit an annual report to the chairman and minority |
21 | chairman of the Appropriations Committee of the Senate and the |
22 | chairman and minority chairman of the Appropriations Committee |
23 | of the House of Representatives listing and providing a brief |
24 | description of all expenditures from the Clean Water Fund for |
25 | the preceding calendar year. The report shall also be posted and |
26 | maintained on the department's publicly accessible Internet |
27 | website. |
28 | Section 2. Section 307 of the act is amended by adding a | <-- |

30 | Section 307. Industrial Waste Discharges.--* * * |

1 | (d) In addition to the exemptions contained in 25 Pa. Code § |
2 | 102.5 (relating to permit requirements), and in accordance with |
3 | the Federal Water Pollution Control Act (62 Stat. 1155, 33 |
4 | U.S.C. § 1342 (l)(2)), the Department of Environmental |
5 | Protection shall not require a National Pollutant Discharge |
6 | Elimination System permit for storm water discharges associated |
7 | with construction activities for oil and gas activities. For |
8 | purposes of this section, "oil and gas activities" shall have |
9 | the same meaning as defined in 25 Pa. Code § 102.1 (relating to |
10 | definitions). |
