THE GENERAL ASSEMBLY OF PENNSYLVANIA


SENATE BILL

No. 1319 Session of 1989


        INTRODUCED BY SHUMAKER, SHAFFER, LEWIS, FISHER, PORTERFIELD,
           BELAN, HELFRICK, DAWIDA, AFFLERBACH AND ANDREZESKI,
           OCTOBER 23, 1989

        SENATOR RHOADES, STATE GOVERNMENT, AS AMENDED, FEBRUARY 6, 1990

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further providing for residual funds.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1630 of the act of June 3, 1937
    15  (P.L.1333, No.320), known as the Pennsylvania Election Code,
    16  added October 4, 1978 (P.L.893, No.171), is amended to read:
    17     Section 1630.  Residual Funds.--
    18     (a)  In the event that a candidate or political committee
    19  terminates its financial activity as such, then the disbursement
    20  of any residual funds remaining in such an account shall be made
    21  by the candidate, political committee or treasurer for either,


     1  in the following manner:
     2     (1)  [any such] The funds may be used for any expenditure as
     3  defined by this article[; and].
     4     (2)  The funds may be returned, pro rata, to the contributors
     5  [by the candidate or treasurer of the political committee. A
     6  final report must be made by the next January 31 in accordance
     7  with section 1627].
     8     (3)  The funds may be donated to an organization qualified as  <--
     9  charitable under section 501(c)(3) of the Internal Revenue Code
    10  of 1986 (Public Law 99-514, 26 U.S.C. § 501(c)(3)).
    11     (3)  THE FUNDS MAY BE DONATED TO ONE OR MORE OF THE FOLLOWING  <--
    12  CORPORATIONS NOT-FOR-PROFIT AS DEFINED IN 15 PA.C.S. § 1103
    13  (RELATING TO DEFINITIONS):
    14     (I)  A CHARITABLE ORGANIZATION UNDER SECTION 501(C)(3) OF THE
    15  INTERNAL REVENUE CODE OF 1986 (PUBLIC LAW 99-514, 26 U.S.C. §
    16  501(C)(3)).
    17     (II)  A NATIONAL VETERANS' ORGANIZATION OR A UNIT OF A
    18  NATIONAL VETERANS' ORGANIZATION.
    19     (III)  AN ORGANIZED FRATERNAL SOCIETY CREATED AND CARRIED ON
    20  FOR THE MUTUAL BENEFIT OF ITS MEMBERS, NOT ISSUING CAPITAL STOCK
    21  BUT HAVING A LIMITED MEMBERSHIP AND A REPRESENTATIVE FORM OF
    22  GOVERNMENT.
    23     (IV)  A RELIGIOUS ORGANIZATION CREATED AND CARRIED ON FOR THE
    24  PREDOMINANT PURPOSE OF REGULARLY HOLDING OR CONDUCTING RELIGIOUS
    25  ACTIVITIES OR RELIGIOUS EDUCATION.
    26     (V)  A VOLUNTEER FIRE COMPANY, VOLUNTEER RESCUE SQUAD OR
    27  VOLUNTEER AMBULANCE ASSOCIATION.
    28     (b)  A final report must be made by the next January 31 in
    29  accordance with section 1627.
    30     Section 2.  This act shall take effect in 60 days.
