AN ACT 1 Amending the act of April 29, 1994 (P.L.141, No.22), entitled 2 "An act providing for the preservation of historic burial 3 places and tombs, monuments and gravestones; and imposing 4 penalties," further defining "historic burial place." 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The definition of "historic burial place" in 8 section 2 of the act of April 29, 1994 (P.L.141, No.22), known 9 as the Historic Burial Places Preservation Act, is amended to 10 read: 11 Section 2. Definitions. 12 The following words and phrases when used in this act shall 13 have the meanings given to them in this section unless the 14 context clearly indicates otherwise: 15 * * * 16 "Historic burial place." Either of the following: 17 (1) A tract of land that has been in existence as a 18 burial ground for more than 100 years wherein there have been
1 no burials for at least 50 years and wherein there will be no 2 future burials or listed in or eligible for the National 3 Register of Historic Places as determined by the Pennsylvania 4 Historical and Museum Commission. 5 (2) A tract of land that has been in existence as a 6 burial ground for 100 years, wherein a fence exists, 7 gravemarkers and headstones are in an upright position, weeds 8 and other debris are removed, private funds have been used 9 for any restoration, a perpetual maintenance fund is 10 established, the owner of the land consents in writing to the 11 designation of the land as an historic burial place and 12 wherein there will be no future burials. 13 * * * 14 Section 2.
