                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for additional
     3     powers and duties.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3009 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 3009.  Additional powers and duties.
     9     * * *
    10     (e.1)  Annual report.--The commission shall collect special
    11  reports concerning the deployment of broadband services from any
    12  local exchange telecommunications company with an alternative or
    13  streamlined form of regulation approved by the commission. Such
    14  local exchange telecommunications companies may be required to
    15  submit this information on an annual basis. Information
    16  concerning the deployment of broadband services may also be
    17  required with any tariff filing, petition for rate rebalancing,
    18  rate change or petition affecting protected services.

     1  Information submitted under this section must include a
     2  description of each available broadband service offered to each
     3  class of customers, the pricing of such service and data showing
     4  the number of customers using such services. The commission,
     5  upon review of the special report concerning broadband services,
     6  may, after notice and hearing, modify the existing alternative
     7  or streamlined form of regulation where the commission
     8  determines that the alternative or streamlined regulation is not
     9  consistent with section 3001 (relating to declaration of
    10  policy), or such services are not being deployed or such
    11  services are not affordable.

    13     Section 2.  This act shall take effect in 60 days.
