SENATE BILL

No. 1330 Session of 2000

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to sell and convey to the
     3     Wernersville Municipal Authority certain land situate on
     4     Wernersville State Hospital, South Heidelburg Township, Berks
     5     County.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  (a)  Authorization.--The Department of General
     9  Services, with the approval of the Governor, is hereby
    10  authorized and directed on behalf of the Commonwealth of
    11  Pennsylvania to grant and convey to the Wernersville Municipal
    12  Authority the tract of land described in subsection (b), for
    13  fair consideration based on a fair market value as determined by
    14  an independent appraisal.
    15     (b)  Description.--The property to be conveyed pursuant to
    16  subsection (a) is the following tract of land situate on
    17  Wernersville State Hospital, Berks County, bounded and described
    18  as follows:
    19  BEGINNING at a point on the northeastern side of Hospital Lane

     1  at edge of the road, said point being South 30 degrees 20
     2  minutes 59 seconds East a distance of 237.93 feet from a marble
     3  monument to a point, then South 30 degrees 20 minutes 59 seconds
     4  East a distance of 227.27 feet to a point, then South 59 degrees
     5  57 minutes 49 seconds West a distance of 264.64 feet to a point,
     6  then South 45 degrees 25 minutes 59 seconds West a distance of
     7  143.34 feet to a point, then North 31 degrees 72 minutes 38
     8  seconds West a distance of 249.37 feet to a point, then North 58
     9  degrees 47 minutes 22 seconds East a distance of 383.99 feet to
    10  a point, being the place of beginning.
    11     CONTAINING 2.000 acres of land in all.
    12     (c)  Easements.--The conveyance shall be made under and
    13  subject to any and all Easements for utilities which cross said
    14  property, including, but not limited to, streets, roadways and
    15  rights of any storm sewer, electric service, potable water
    16  service, as well as under and subject to any interest, estates
    17  or tenancies vested in third persons appearing of record, for
    18  any portion of the land or improvements erected thereon.
    19     (d)  Execution.--The deed of conveyance shall be approved as
    20  provided by law and shall be executed by the Secretary of
    21  General Services in the name of the Commonwealth of
    22  Pennsylvania. In the event this property is not conveyed to
    23  Wernersville Municipal Authority within five years of the
    24  effective date of this act, at the discretion of the Secretary
    25  of General Services, the property may be offered for sale
    26  through auction, sealed bid or request for proposal, under terms
    27  of the act of April 9, 1929 (P.L.177, No.175), known as The
    28  Administrative Code of 1929, and conditions in section 2405-A of
    29  The Administrative Code of 1929 authorizing the sale of the
    30  herein noted property to Wernersville Municipal Authority shall

     1  automatically cease and become null and void.
     2     (e)  Costs.--All other costs and fees, including, but not
     3  limited to, appraisal fees, title insurance and surveys,
     4  incidental to this conveyance, shall be borne by the Grantee.
     5     Section 2.  This act shall take effect immediately.
