SENATE BILL

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting employment contracts that
     3     restrict reporting of safety violations at nuclear-powered
     4     electric generating units.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 7326.  Employment contracts restricting reporting of safety
    10             violations at nuclear-powered electric generating
    11             units.
    12     (a)  General rule.--A high managerial agent of a public
    13  utility operating a nuclear-powered electric generating unit or
    14  a high managerial agent of a contractor that provides services
    15  or materials to the operator of a nuclear-powered electirc
    16  generating unit commits a misdemeanor of the first degree if he
    17  authorizes or executes, on behalf of the public utility or
    18  contractor, a collective bargaining agreement, employment


     1  contract or other agreement that restricts or impedes an
     2  employee or former employee from reporting violations of laws,
     3  regulations or established safe operating procedures involving a
     4  nuclear-powered electric generating unit to the Pennsylvania
     5  Public Utility Commission.
     6     (b)  Definition.--As used in this section, the term "high
     7  managerial agent" means an officer of a corporation or an
     8  unincorporated association, or, in the case of a partnership, a
     9  partner, or any other agent of a corporation or association
    10  having duties of such responsibility that his conduct may fairly
    11  be assumed to represent the policy of the corporation or
    12  association.
    13     Section 2.  This act shall take effect in 60 days.
