1Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2Statutes, in public works contracts, providing for recreation
3and fitness equipment.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 62 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 3914. Recreation and fitness equipment.

9(a) General rule.--Whenever a local government unit intends
10to procure recreation or fitness equipment and the installation
11thereof, the local government unit may calculate the entire
12cost, value or amount of the equipment separately from that of
13the installation in order to determine whether the procurement
14is subject to the competitive bid requirements of any law
15relating to the local government unit.

16(b) Intergovernmental relations.--The department may not
17exclude a local government unit from participating as a local
18government procurement unit, as defined in section 1901
19(relating to definitions), in a cooperative purchasing program

1administered by the department under Chapter 19 (relating to
2intergovernmental relations) because the local government unit
3intends to solicit separate bids for recreation or fitness
4equipment and the installation thereof as authorized under this
5section.

6(c) Applicability.--This section applies to any contract
7regardless of the dollar amount and the definition of "contract"
8in section 3902 (relating to definitions).

9Section 2. This act shall take effect in 60 days.
