SENATE BILL

No. 1382 Session of 1989


        INTRODUCED BY CORMAN, RHOADES, AFFLERBACH AND STOUT,
           DECEMBER 5, 1989

        REFERRED TO LABOR AND INDUSTRY, DECEMBER 5, 1989

                                     AN ACT

     1  Amending the act of June 2, 1915 (P.L.736, No.338), entitled "An
     2     act defining the liability of an employer to pay damages for
     3     injuries received by an employe in the course of employment;
     4     establishing an elective schedule of compensation; providing
     5     procedure for the determination of liability and compensation
     6     thereunder; and prescribing penalties," further providing for
     7     the payment of workmen's compensation premiums.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 601 of the act of June 2, 1915 (P.L.736,
    11  No.338), known as The Pennsylvania Workmen's Compensation Act,
    12  reenacted and amended June 21, 1939 (P.L.520, No.281), is
    13  amended by adding a subsection to read:
    14     Section 601.  * * *
    15     (e)  Each municipality which does not have a fire company,
    16  ambulance corps or rescue and lifesaving squad located within
    17  its corporate limits and which receives fire protection
    18  services, ambulance services or rescue and lifesaving services
    19  from the volunteer fire company, volunteer ambulance corps or
    20  volunteer rescue and lifesaving squad of another municipality

     1  pursuant to a contract, standing agreement or arrangement shall
     2  reimburse the municipality maintaining the volunteer fire
     3  company, volunteer ambulance corps or volunteer rescue and
     4  lifesaving squad for a portion of the cost of the workmen's
     5  compensation premiums covering members of the volunteer fire
     6  company, volunteer ambulance corps or volunteer rescue and
     7  lifesaving squad. The appropriate portion of the cost shall be
     8  determined by multiplying the entire cost of the premium by the
     9  percentage that the individual municipality's population served
    10  by such volunteer fire company, volunteer ambulance corps or
    11  volunteer rescue and lifesaving squad bears to the total
    12  population served by such volunteer fire company, volunteer
    13  ambulance corps or volunteer rescue and lifesaving squad or be
    14  determined by agreement between the municipalities.
    15     Section 2.  This act shall take effect in 30 days.
