SENATE BILL

No. 1387 Session of 2006

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey, at a price to
     3     be determined through a request for proposal, certain lands,
     4     buildings and improvements situate in the City and County of
     5     Philadelphia, known as the Philadelphia State Office
     6     Building.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  Conveyance in City and County of Philadelphia.
    10     (a)  Authorization.--The Department of General Services, with
    11  the approval of the Governor, is hereby authorized on behalf of
    12  the Commonwealth of Pennsylvania to grant and convey the
    13  following tract of land described in subsection (b) together
    14  with any buildings, structures or improvements thereon, situate
    15  in the City and County of Philadelphia, Pennsylvania. The
    16  Department shall sell the property using, in its discretion, one
    17  of the following methods of sale: invitation for sealed bids,
    18  request for proposals or auction.
    19     (b)  Legal description.--The property to be conveyed pursuant


     1  to Section 1 consists of approximately 1.89-acres and an office
     2  building bounded and more particularly described as follows:
     3     ALL THAT CERTAIN lot or piece of ground situate in the
     4  Fifteenth Ward of the City of Philadelphia, more fully bounded
     5  and described as follows, to wit:
     6     BEGINNING at a point of intersection of the Southerly side of
     7  Spring Garden Street (120 feet wide) and the Westerly side of
     8  Broad Street (113 feet wide); thence extending Southwardly along
     9  the Westerly side of Broad Street 207 feet 8 inches to the point
    10  of intersection of the Northerly side of Buttonwood Street (40
    11  feet wide); thence extending Westwardly along the Northerly side
    12  of Buttonwood Street 395 feet 8 inches to the Easterly side of
    13  Fifteenth Street (50 feet wide); thence extending Northwardly
    14  along the Easterly side of Fifteenth Street 207 feet 8 inches to
    15  the Southerly side of Spring Garden Street; thence extending
    16  Eastwardly along the southerly side of Spring Garden Street 395
    17  feet 8 inches to the first mentioned point and place of
    18  BEGINNING.
    19     Containing approximately 1.89-acres more or less.
    20     Being the same parcel and tract of land conveyed to the
    21  Commonwealth of Pennsylvania, Department of General Services, by
    22  the General State Authority in its deed, dated July 11, 1997,
    23  recorded in the Philadelphia Recorder of Deeds Office in Deed
    24  Book 398, Page 560.
    25     (c)  Conditions of conveyance.--The conveyance shall be made
    26  under and subject to all lawful and enforceable easements,
    27  servitudes and rights of others, including but not confined to
    28  streets, roadways and rights of any telephone, telegraph, water,
    29  electric, gas or pipeline companies, as well as under and
    30  subject to any lawful and enforceable estates or tenancies

     1  vested in third persons appearing of record, for any portion of
     2  the land or improvements erected thereon.
     3     (d)  Land use restriction.--Any conveyance authorized under
     4  this section shall be made under and subject to the condition,
     5  which shall be contained in the deed of conveyance, that no
     6  portion of the property conveyed shall be used as a licensed
     7  facility, as defined in 4 Pa.C.S. § 1103 (relating to
     8  definitions), or any other similar type of facility authorized
     9  under State law. The condition shall be a covenant running with
    10  the land and shall be binding upon the grantee, its successors
    11  and assigns. Should the grantee, its successors or assigns,
    12  permit any portion of the property authorized to be conveyed in
    13  this section to be used in violation of this subsection, the
    14  title shall immediately revert to and revest in the grantor.
    15     (e)  Execution of deed.--The deed of conveyance shall be by
    16  Special Warranty Deed and shall be executed by the Secretary of
    17  General Services in the name of the Commonwealth of
    18  Pennsylvania.
    19     (f)  Costs and fees.--All costs and fees incurred by the
    20  Department of General Services in selling the property shall be
    21  paid from the purchase price and that amount shall be an
    22  executively authorized augmentation to the appropriation from
    23  which the costs and fees were paid by the Department of General
    24  Services. An amount equal to any outstanding Commonwealth
    25  general obligation debt for the renovations to the Philadelphia
    26  State Office Building from 1989 to present shall be deducted
    27  from the proceeds of the sale of the building and deposited in
    28  the Capital Facilities Fund. The balance of the proceeds of the
    29  sale shall be deposited in the General Fund.
    30  Section 2.  Effective date.
