SENATE BILL

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for suspension of implementation of
     3     certain taxes for highway maintenance and construction by
     4     gubernatorial proclamation or executive order.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 75 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 9502.1.  Suspension of tax.
    10     (a)  General rule.--The Governor, by proclamation or
    11  executive order, may suspend implementation, in part or in
    12  total, of section 9502 (relating to imposition of tax) if:
    13         (1)  the average wholesale price for all liquid fuels and
    14     fuels, as defined in Chapter 90 (relating to liquid fuels and
    15     fuels tax), has experienced a more than 10% increase within a
    16     period of one month or less; and
    17         (2)  the Governor, in his discretion, determines that the
    18     increase in average wholesale price is detrimental to the


     1     health, safety and welfare of the citizens of this
     2     Commonwealth.
     3     (b)  Proclamation or executive order.--A proclamation or
     4  executive order under subsection (a) shall remain in effect for
     5  up to three months and may be reissued by the Governor.
     6     Section 2.  This act shall take effect immediately.
