                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, regulating the price marking of
     3     grocery items.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7326.  Price marking of grocery items.
     9     (a)  Price display required.--Every store which sells, offers
    10  for sale or exposes for sale grocery items and at which more
    11  than six persons are employed shall display the selling price of
    12  each grocery item.
    13     (b)  Manner of display.--The selling price shall, at a
    14  minimum, be displayed in clear, conspicuous and plainly visible
    15  Arabic numerals on a shelf tag positioned in the middle of the
    16  items displayed. The shelf tag for packaged goods shall, in
    17  addition to the selling price, display the price per unit of
    18  measure.

     1     (c)  Offense defined.--Any person who by himself or by his
     2  servant or agent, or as the servant or agent of another person,
     3  violates the provisions of this section commits a summary
     4  offense and shall, for the first offense, be sentenced to pay a
     5  fine of not less than $50 nor more than $200 and, for a second
     6  or subsequent offense, be sentenced to pay a fine of not less
     7  than $100 nor more than $500, or to imprisonment for not more
     8  than one year, or both.
     9     (d)  Definition.--As used in this section, the term "grocery
    10  items" means all food items meant for human consumption and sold
    11  at retail or at discount.
    12     Section 2.  This act shall take effect in 60 days.
