SENATE BILL

                                     AN ACT

     1  Amending the act of October 5, 1994 (P.L.531, No.78), entitled
     2     "An act providing for the establishment of the Human Services
     3     Development Fund and for its administration and operation;
     4     and imposing additional powers and duties on the Department
     5     of Public Welfare," further providing for allocations.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 7 of the act of October 5, 1994 (P.L.531,
     9  No.78), known as the Human Services Development Fund Act, is
    10  amended to read:
    11  Section 7.  Allocations.
    12     (a)  General formula.--[An] Except as set forth in subsection
    13  (a.1), an annual appropriation shall be distributed among the
    14  counties as follows:
    15         (1)  50% shall be allocated on a per capita basis.
    16         (2)  50% shall be allocated on a poverty level basis.
    17     (a.1)  Cost-of-living increase.--An increase in the State
    18  allocation up to the rate of the Consumer Price Index of the
    19  previous year shall be distributed as a cost-of-living

     1  adjustment to all counties. Any remainder of the increase shall
     2  be distributed through the formula set forth in subsection
     3  (a)(1) and (2).
     4     (b)  Minimum.--Except as provided in subsection (c), no
     5  county shall receive a grant in an amount which is less than the
     6  amount it received in the immediately preceding fiscal year.
     7     (c)  Reductions.--
     8         (1)  If a reduction in funding occurs, each county's
     9     allocation shall be reduced on a pro rata basis subject to
    10     paragraph (2).
    11         (2)  No county shall receive less than $50,000.
    12     (d)  Data to be used to compute formula.--The most recently
    13  available data shall be used in applying the formula set forth
    14  in subsection (a).
    15     Section 2.  This act shall take effect in 60 days.
