AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for trains blocking crossings.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 3713 of Title 75 of the Pennsylvania
6 Consolidated Statutes is amended to read:
7 § 3713. Railroad trains not to block crossings.
8 (a) Offense.--No person or government agency shall operate
9 any train in such a manner as to prevent vehicular use of any
10 roadway for a period of time in excess of five consecutive
11 minutes except under any of the following circumstances:
12 (1) When necessary to comply with signals affecting the
13 safety of the movement of trains.
14 (2) When necessary to avoid striking any object or
15 person on the track.
16 (3) When the train is disabled.
17 (4) When the train is in motion except while engaged in
1 switching operations. 2 (5) When there is no vehicular traffic waiting to use 3 the crossings. 4 (6) When necessary to comply with a governmental safety 5 regulation. 6 (b) Penalty.--A person or government agency that violates 7 this section commits a summary offense and shall, upon 8 conviction, be sentenced to pay a fine of $100 for each five 9 minutes or portion thereof during which the violation occurs. 10 Section 2.
