1 hereby enacts as follows: 2 Section 1. SECTION 1(E) OF THE ACT IS AMENDED TO READ: 24 Section 1. HOLLIDAYSBURG BOROUGH, BLAIR COUNTY. 4 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 5 THE APPROVAL OF THE GOVERNOR AND DEPARTMENT OF TRANSPORTATION, 6 IS HEREBY AUTHORIZED AND DIRECTED ON BEHALF OF THE COMMONWEALTH 7 OF PENNSYLVANIA TO GRANT, SELL AND CONVEY BY SPECIAL WARRANTY 8 DEED TO BOROUGH OF HOLLIDAYSBURG FOR FAIR CONSIDERATION EQUAL TO 9 THE FAIR MARKET VALUE AS DETERMINED BY AN INDEPENDENT APPRAISAL, 10 THE TRACT OF LAND AND BUILDINGS DESCRIBED IN SUBSECTION (B). 11 (B) DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO 12 SUBSECTION (A) IS THE FOLLOWING TRACT OF LAND CONSISTING OF THE 13 DEPARTMENT OF TRANSPORTATION'S BLAIR COUNTY MAINTENANCE FACILITY 14 SITUATE IN THE BOROUGH OF HOLLIDAYSBURG, BLAIR COUNTY, 15 PENNSYLVANIA, BOUNDED AND DESCRIBED AS FOLLOWS: 16 BEGINNING AT AN IRON PIN ON THE NORTHEASTERLY SIDE OF BEDFORD 17 STREET, SAID IRON PIN BEING N. 30 DEGREES 40 MINUTES W. SIXTY-FIVE (65) FEET TO THE POINT OF BEGINNING. 9 CONTAINING 0.8158 OF AN ACRE, MORE OR LESS. 10 (C) CONDITION.--THE CONVEYANCE AUTHORIZED BY THIS SECTION IS 11 SUBJECT TO THE COMMONWEALTH OF PENNSYLVANIA'S COMPLETION OF A 12 NEW MAINTENANCE SHED FOR THE PENNSYLVANIA DEPARTMENT OF 13 TRANSPORTATION, HEREINAFTER REFERRED TO AS PADOT, AND PADOT 14 VACATING THE ABOVE DESCRIBED TRACT OF LAND. 15 (D) EASEMENTS.--THE CONVEYANCE AUTHORIZED BY THIS SECTION 16 SHALL BE MADE UNDER AND SUBJECT TO ALL LAWFUL AND ENFORCEABLE 17 EASEMENTS, SERVITUDES, INFRINGEMENTS KNOWN OR UNKNOWN AND RIGHTS 18 OF OTHERS, INCLUDING, BUT NOT CONFINED TO, STREETS, ROADWAYS AND 19 RIGHTS OF ANY TELEPHONE, TELEGRAPH, CABLE, WATER, ELECTRIC, 20 SEWER, GAS OR PIPELINE COMPANIES, AS WELL AS UNDER THE SUBJECT 21 TO ANY LAWFUL AND ENFORCEABLE INTEREST, ESTATES OR TENANCIES 22 VESTED IN THIRD PERSONS APPEARING OF RECORD, FOR ANY PORTION OF 23 THE LAND OR IMPROVEMENTS ERECTED THEREON. 24 (E) RESTRICTIONS.--THE DEED OF CONVEYANCE SHALL CONTAIN A 25 CLAUSE THAT THE PROPERTY CONVEYED SHALL BE USED FOR MUNICIPAL 26 PURPOSES, AND, IF AT ANY TIME THE BOROUGH OF HOLLIDAYSBURG, OR 27 ITS SUCCESSOR IN FUNCTION CONVEYS THE PROPERTY OR PERMITS THE 28 PROPERTY TO BE USED FOR ANY PURPOSE OTHER THAN THAT SPECIFIED IN 29 THIS SUBSECTION, THE TITLE TO THE PROPERTY SHALL IMMEDIATELY 30 REVERT TO AND REVEST IN THE COMMONWEALTH OF PENNSYLVANIA. 20000S1468B2323 - 5 -
1 (F) EXECUTION.--THE DEED OF CONVEYANCE AUTHORIZED BY THIS 2 SECTION SHALL BE APPROVED AS PROVIDED BY LAW AND SHALL BE 3 EXECUTED BY THE SECRETARY OF GENERAL SERVICES IN THE NAME OF THE 4 COMMONWEALTH OF PENNSYLVANIA. IN THE EVENT THAT THIS CONVEYANCE 5 IS NOT EXECUTED WITHIN 12 MONTHS OF THE EFFECTIVE DATE OF THIS 6 ACT, OR WITHIN 12 MONTHS OF PADOT VACATING THE PREMISES, 7 WHICHEVER IS LATER, THE PROPERTY MAY BE DISPOSED OF IN 8 ACCORDANCE WITH ARTICLE XXIV-A OF THE ACT OF APRIL 9, 1929 9 (P.L.177, NO.175), KNOWN AS THE ADMINISTRATIVE CODE OF 1929. 10 (G) GOVERNMENT APPROVALS.--GRANTEE SHALL BE SOLELY 11 RESPONSIBLE TO OBTAIN ALL REQUIRED SUBDIVISION APPROVALS AND ALL 12 OTHER GOVERNMENTAL APPROVALS NECESSARY FOR THE TRANSFER OR 13 INTENDED USE OF THE TRANSFERRED TRACT AND ITS BUILDINGS REQUIRED 14 AS A RESULT OF THIS CONVEYANCE. ALL FEES AND COSTS ASSOCIATED 15 WITH OBTAINING THE SUBDIVISION OR OTHER APPROVALS SHALL BE BORNE 16 BY THE GRANTEE. 17 (H) COSTS AND FEES.--ALL OTHER COSTS AND FEES INCIDENTAL TO 18 THE CONVEYANCE INCLUDING, BUT NOT LIMITED TO, APPRAISAL FEES, 19 TITLE INSURANCE, SURVEY AUTHORIZED BY THIS SECTION SHALL BE 20 BORNE BY THE GRANTEE. 21 (I) GENERAL FUND.--PROCEEDS FROM THIS SALE SHALL BE 22 DEPOSITED IN THE GENERAL FUND. 23 SECTION 4.2. CONVEYANCE TO EASTERN SNYDER COUNTY REGIONAL 24 AUTHORITY. 25 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 26 THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED 27 TO CONVEY TO THE EASTERN SNYDER COUNTY REGIONAL AUTHORITY THE 28 TRACT OF LAND DESCRIBED IN SUBSECTION (B), IN EXCHANGE FOR THE 29 TRACT OF LAND DESCRIBED IN SUBSECTION (C). 30 (B) LAND TO BE CONVEYED FROM THE COMMONWEALTH.--ALL THAT 20000S1468B2323 - 6 -

BEING PART OF THE SAME 16 RIGHT-OF-WAY AS DESCRIBED IN DEED BOOK 144, PAGE 312. 17 (D) DEED.--THE DEED OF CONVEYANCE SHALL BE APPROVED AS 18 PROVIDED BY LAW AND SHALL BE EXECUTED BY THE DEPARTMENT OF 19 GENERAL SERVICES IN THE NAME OF THE COMMONWEALTH. 20 (E) COSTS AND FEES.--THE COSTS AND FEES INCIDENTAL TO THIS 21 CONVEYANCE SHALL BE BORNE BY THE GRANTEE. 22 SECTION 4.3. PENN TOWNSHIP, SNYDER COUNTY. 23 (A) AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH 24 THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED 25 ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND 26 CONVEY TO SNYDER COUNTY CERTAIN LAND DESCRIBED IN SUBSECTION (B) 27 FOR FAIR MARKET VALUE AS DETERMINED BY INDEPENDENT APPRAISAL. 28 (B) DESCRIPTION.--THE PROPERTY TO BE CONVEYED PURSUANT TO 29 SUBSECTION (A) CONSISTS OF APPROXIMATELY 7 ACRES BOUNDED AND 30 MORE PARTICULARLY DESCRIBED AS FOLLOWS: 20000S1468B2323 - 8 -
