                                     AN ACT

     1  Amending the act of July 10, 1990 (P.L.404, No.98), entitled "An
     2     act providing for the certification of real estate
     3     appraisers; specifying requirements for certification;
     4     providing for sanctions and penalties; and making an
     5     appropriation," further providing for certified real estate
     6     appraiser application and for disciplinary and corrective
     7     measures.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 6(c) of the act of July 10, 1990
    11  (P.L.404, No.98), known as the Real Estate Appraisers
    12  Certification Act, amended October 18, 2000 (P.L.600, No.77), is
    13  amended to read:
    14  Section 6.  Application and qualifications.

    16     (c)  Application.--An applicant for certification as a
    17  certified real estate appraiser shall submit a written
    18  application on forms provided by the board. The application and
    19  any and all documentation submitted with the application shall
    20  be subscribed and sworn to before a notary public. The applicant

     1  shall be held responsible for the statements contained in the
     2  application. The making of a false statement in an application
     3  may constitute a ground for license denial or revocation. The
     4  application shall evidence that:
     5         (1)  He or she is of good moral character.
     6         (2)  His or her application has been accompanied by the
     7     application fee.
     8         (3)  He or she has not had a license or certificate to
     9     perform appraisals revoked or refused by an appraisal
    10     licensure or certification authority of another state,
    11     territory or county.

    13     Section 2.  Section 11(a) of the act is amended by adding a
    14  paragraph and the section is amended by adding a subsection to
    15  read:
    16  Section 11.  Disciplinary and corrective measures.
    17     (a)  Authority of board.--The board may deny, suspend or
    18  revoke certificates, or limit, restrict or reprimand a
    19  certificateholder for any of the following causes:

    21         (16)  Failing or refusing to provide to an applicant a
    22     copy of the appraisal report used in connection with an
    23     application for credit that is to be secured by a lien on a
    24     dwelling.

    26     (b.1)  Fraud.--When the board finds that a State-certified
    27  real estate appraiser has fraudulently developed an appraisal,
    28  prepared an appraisal report or communicated an appraisal, the
    29  board shall revoke the certificate of the appraiser.
