AN ACT 1 Requiring a notice concerning employee rights regarding union 2 membership to be placed in all public employee contracts and 3 to be posted at all public employee worksites; and providing 4 penalties. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Definitions. 8 The following words and phrases when used in this act shall 9 have the meanings given to them in this section unless the 10 context clearly indicates otherwise: 11 "Employer." The Commonwealth, any county, municipality, 12 school district and any other governmental authority or 13 instrumentality. 14 "Job site." Any office, construction site, warehouse, 15 building or any other place where a public employee may perform 16 job duties, excluding vehicles. 17 "Public employee." Any employee employed by an employer. 18 Section 2. Notice.
1 (a) Contracts.--Every contract between an employer and 2 public employees entered into after the effective date of this 3 section shall contain the following notice: 4 NOTICE TO EMPLOYEES 5 Under Federal law, employees cannot be required to join a 6 union or maintain membership in a union in order to 7 retain their jobs. Under certain conditions, the law 8 permits a union and an employer to enter into a union- 9 security agreement requiring employees to pay uniform 10 periodic dues and initiation fees. However, employees who 11 are not union members can object to the use of their 12 payments for certain purposes and can only be required to 13 pay their share of union costs relating to collective 14 bargaining, contract administration and grievance 15 adjustment. 16 If you believe that you have been required to pay dues or 17 fees used in part to support activities not related to 18 collective bargaining, contract administration or 19 grievance adjustment, you may be entitled to a refund and 20 to an appropriate reduction in future payments. 21 For further information concerning your rights, you may 22 wish to contact either a Regional Office of The National 23 Labor Relations Board or: 24 National Labor Relations Board 25 Division of Information 26 1717 Pennsylvania Avenue, N.W. 27 Washington, D.C. 20570 28 or 29 Pennsylvania Labor Relations Board 30 Room 1601, Labor and Industry Building 19980S1486B2106 - 2 -
1 Forster and Seventh Streets 2 Harrisburg, PA 17120 3 (b) Workplace notices.--The notice required by subsection 4 (a) shall be posted at every employer worksite in a prominent 5 and easily accessible place at or near other labor law notices 6 that are required by law to be so posted. 7 Section 3. Penalties. 8 Any employer who violates this act shall be subject to the 9 penalties as set forth in the Fair Labor Standards Act of 1938 10 (52 Stat. 1060, 29 U.S.C. § 201 et seq.). 11 Section 4.
