SENATE BILL

                                     AN ACT

     1  Amending the act of December 27, 1951 (P.L.1793, No.475),
     2     entitled "An act providing for the marking of liquefied
     3     petroleum gas containers and prohibiting the refilling or use
     4     of such containers without authorization by the owner
     5     thereof; authorizing the Department of Labor and Industry,
     6     after public hearing, to prescribe uniform regulations for
     7     safety in the design, construction, location, installation
     8     and operation of equipment for storing, handling,
     9     transporting by tank truck or tank trailer and utilizing
    10     liquefied petroleum gases for fuel purposes and for the
    11     odorization of said gases used therewith; prohibiting the
    12     adoption by municipalities or other political subdivisions of
    13     ordinances or regulations in conflict with this act;
    14     providing for prosecutions for violations of this act by
    15     summary proceedings, and prescribing the penalty therefor,"
    16     further providing for the filling or refilling of liquefied
    17     petroleum gas containers.

    18     The General Assembly of the Commonwealth of Pennsylvania
    19  hereby enacts as follows:
    20     Section 1.  Section 2 of the act of December 27, 1951
    21  (P.L.1793, No.475), referred to as the Liquefied Petroleum Gas
    22  Act, is amended to read:
    23     Section 2.  No person, firm or corporation, other than the
    24  owner and those authorized by the owner so to do, shall sell,
    25  fill, refill, deliver or permit to be delivered or used, in any

     1  manner, any liquefied petroleum gas container or receptacle for
     2  any gas compound or for any other purpose. This section shall
     3  not be construed to prohibit the filling or refilling of a
     4  liquefied petroleum gas container for use by a residential
     5  customer dependent upon liquefied petroleum gas for heating or
     6  cooking, by a person other than the owner of the container or
     7  those authorized by the owner, during a period when the owner or
     8  those authorized by the owner have no liquefied petroleum gas
     9  available for delivery.
    10     Section 2.  This act shall take effect immediately.
