SENATE BILL

No. 1514 Session of 2002


        INTRODUCED BY KUKOVICH AND COSTA, AUGUST 30, 2002

        REFERRED TO LABOR AND INDUSTRY, AUGUST 30, 2002

                                     AN ACT

     1  Amending the act of June 2, 1915 (P.L.736, No.338), entitled, as
     2     reenacted and amended, "An act defining the liability of an
     3     employer to pay damages for injuries received by an employe
     4     in the course of employment; establishing an elective
     5     schedule of compensation; providing procedure for the
     6     determination of liability and compensation thereunder; and
     7     prescribing penalties," further providing for the definition
     8     of "employe" to include employees coming to the aid of other
     9     persons.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 601(a) of the act of June 2, 1915
    13  (P.L.736, No.338), known as the Workers' Compensation Act,
    14  reenacted and amended June 21, 1939 (P.L.520, No.281), is
    15  amended by adding a clause to read:
    16     Section 601.  (a)  In addition to those persons included
    17  within the definition of the word "employe" as defined in
    18  section 104, "employe" shall also include:
    19     * * *
    20     (9)  An employe who, while in the course and scope of his
    21  employment, goes to the aid of any person and suffers physical

     1  or mental injury or death as a direct result of any of the
     2  following:
     3     (i)  Preventing the commission of a crime, lawfully
     4  apprehending a person reasonably suspected of having committed
     5  such crime or aiding the victim of such crime. For purposes of
     6  this clause, the terms "crime" and "victim" shall have the same
     7  meanings as given to the terms in section 103 of the act of
     8  November 24, 1998 (P.L.882, No.111), known as the "Crime Victims
     9  Act."
    10     (ii)  Rendering emergency care, first aid or rescue at the
    11  scene of an emergency.

    13     Section 2.  This act shall take effect in 60 days.
