AN ACT 1 Amending the act of December 15, 1986 (P.L.1585, No.174), 2 entitled "An act defining and providing for the licensing and 3 regulation of private schools; establishing the State Board 4 of Private Licensed Schools; imposing penalties; and making 5 repeals," further providing for the definition of "private 6 licensed school"; and defining "seminar." 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The definition of "private licensed school" in 10 section 2 of the act of December 15, 1986 (P.L.1585, No.174), 11 known as the Private Licensed Schools Act, amended July 2, 1996 12 (P.L.495, No.81), is amended and the section is amended by 13 adding a definition to read: 14 Section 2. Definitions. 15 The following words and phrases when used in this act shall 16 have the meanings given to them in this section unless the 17 context clearly indicates otherwise: 18 * * * 19 "Private licensed school." A school or classes operated for
1 profit or tuition that provides resident instruction to prepare 2 an individual to pursue an occupation in the skilled trades, 3 industry or business, or systematic instruction by 4 correspondence or by telecommunication in a field of study. It 5 shall not include a private academic school as defined in the 6 act of June 25, 1947 (P.L.951, No.401), entitled, as amended, 7 "An act defining and providing for the licensing and regulation 8 of private academic schools; conferring powers and imposing 9 duties on the State Board of Private Academic Schools; and 10 imposing penalties"; a school maintained or a class conducted 11 for training for the vocation of homemaking or to give training 12 in public and other service occupations; a barber school; a 13 school of cosmetology; a flight school; a private tutorial 14 school, including, but not limited to, a school of music or 15 dance; an institution granting a degree other than those 16 approved to award the degree of associate in specialized 17 business or associate in specialized technology; a school or 18 class conducted by an employer or trade union for employees or 19 union members where no fee or tuition is charged; a school owned 20 and operated by a bona fide religious institution whose only 21 purpose is the providing of religious instruction; a school 22 conducted by the Commonwealth or a political subdivision 23 thereof; [or] a school which is operated by a hospital licensed 24 under the act of July 19, 1979 (P.L.130, No.48), known as the 25 Health Care Facilities Act, and which is accredited by a 26 regional or national accreditation agency[.]; or a seminar as 27 defined in this act. 28 * * * 29 "Seminar." For purposes of this act, a seminar is: 30 (1) noncumulative short-term training of no more than 15 19980S1518B2139 - 2 -
1 hours duration, not scheduled in a regular calendar format 2 and offered as an introduction or orientation to an 3 occupation or as advanced-level training to those already 4 engaged in skilled trades, industry or business; or 5 (2) instruction offered at a total contract price of 6 less than $300, provided that the total contract price for 7 all courses to any enrolled student is less than $300 in any 8 one calendar year. 9 Section 2.
