SENATE BILL

No. 1539 Session of 1998

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for duty of sheriff
     3     to conduct investigation upon application for firearm
     4     license.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6109(d) of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 6109.  Licenses.

    11     (d)  Sheriff to conduct investigation.--The sheriff to whom
    12  the application is made shall investigate the applicant's record
    13  of criminal convictions, shall investigate whether or not the
    14  applicant is under indictment for or has ever been convicted of
    15  a crime punishable by imprisonment exceeding one year, shall
    16  investigate whether the applicant's character and reputation are
    17  such that the applicant will not be likely to act in a manner
    18  dangerous to public safety and shall investigate whether the


     1  applicant would be precluded from receiving a license under
     2  subsection (e)(1) or section 6105(h) (relating to persons not to
     3  possess, use, manufacture, control, sell or transfer firearms)
     4  [and shall conduct a criminal background, juvenile delinquency
     5  or mental health check following the procedures set forth in
     6  section 6111 (relating to firearm ownership)].

     8     Section 2.  This act shall take effect in 60 days.
