AN ACT 1 Authorizing the release of Project 70 restrictions imposed on a 2 certain tract of land in Mercer County owned by the 3 Pennsylvania Game Commission in exchange for the imposition 4 of Project 70 restrictions on a certain tract of land in 5 Mercer County to be conveyed to the commission. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Mercer County. 9 (a) Authorization.--Under the requirements of section 20(b) 10 of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as 11 the Project 70 Land Acquisition and Borrowing Act, the General 12 Assembly hereby authorizes the release of the restrictions 13 imposed by the Project 70 Land Acquisition and Borrowing Act 14 from the tract of land owned by the Pennsylvania Game 15 Commission, being conveyed to Dale Deist, and more particularly 16 described in subsection (c), in exchange for the imposition of 17 Project 70 restrictions on a tract of land to be acquired by 18 Dale Deist, being conveyed to the Pennsylvania Game Commission, 19 and more particularly described in subsection (d).
1 (b) Freedom of restrictions.--The lands described in 2 subsection (c), owned by the Pennsylvania Game Commission and 3 being conveyed to Dale Deist, shall be free of the restrictions 4 on use and alienation imposed by the Project 70 Land Acquisition 5 and Borrowing Act upon the imposition of and recording of the 6 Project 70 deed restrictions set forth in subsection (e) on the 7 tract of replacement land to be acquired by Dale Deist and being 8 conveyed to the Pennsylvania Game Commission, described in 9 subsection (d). 10 (c) Land to be released from restrictions.--The tract of 11 land authorized to be released from restrictions is located in 12 Sandy Creek Township, Mercer County, and more particularly 13 described as follows: 14 Beginning at a point in the centerline of U.S. Route 19 15 THENCE South 65 degrees 22 minutes 00 seconds East for a 16 distance of 62.40 feet to a pt.; 17 THENCE South 31 degrees 24 minutes 00 seconds East for a 18 distance of 543.03 feet to a pt.c/l T-718; 19 THENCE South 63 degrees 23 minutes 00 seconds West for a 20 distance of 162.79 feet to a pt.c/l T-718; 21 THENCE along a curve to the left having a radius of 678.07 22 feet and an arc length of 207.30 feet, being subtended by a 23 chord of South 54 degrees 38 minutes 00 seconds West for a 24 distance of 206.49 feet to a pt.c/l T-718; 25 THENCE South 45 degrees 52 minutes 00 seconds West for a 26 distance of 66.08 feet to a pt.c/l T-718; 27 THENCE North 60 degrees 16 minutes 00 seconds West for a 28 distance of 284.81 feet to a pt.c/l int. T-718 & U.S. Route 19; 29 THENCE North 24 degrees 38 minutes 00 seconds East for a 30 distance of 645.52 feet to a pt.c/l Rt. 19 the PLACE OF 20000S1547B2171 - 2 -
1 BEGINNING; 2 CONTAINING 5.13 acres, more or less. 3 (d) Land on which restrictions are to be imposed.--The 4 replacement tract of land to be subject to restriction in 5 exchange for the tract of land described in subsection (c) is 6 located in Sandy Creek Township, Mercer County, and more 7 particularly described as follows: 8 Beginning at a nail in the centerline of State Route No. 9 1018, 10 THENCE South 81 degrees 45 minutes 00 seconds East for a 11 distance of 578.01 feet to a nail in centerline; 12 THENCE South 02 degrees 44 minutes 00 seconds West for a 13 distance of 1611.10 feet to a point; 14 THENCE North 85 degrees 33 minutes 00 seconds West for a 15 distance of 591.05 feet to a point; 16 THENCE North 03 degrees 16 minutes 00 seconds East for a 17 distance of 1649.08 feet to a nail in c/l the PLACE OF 18 BEGINNING; 19 CONTAINING 21.83 acres, more or less. 20 (e) Deed restriction.--The restriction to be included in the 21 deed to the tract of land described in subsection (d) shall read 22 as follows: 23 This indenture is given to provide land for recreation, 24 conservation and historical purposes as those purposes 25 are defined in the act of June 22, 1964 (Sp.Sess., 26 P.L.131, No.8), known as the Project 70 Land Acquisition 27 and Borrowing Act. 28 (f) Costs.--The parties to the transaction shall bear their 29 respective costs. 30 (g) Execution.--The deed of conveyance shall be executed and 20000S1547B2171 - 3 -
